What you will need
Use the papers in this order.
Before you start, collect these papers.
Have ready:
- The agreement to sell and the receipts for the advance and any other payments
- ID proof and address proof of everyone who will sign
If the agreement was registered, or you want a deed that stands on its own, make the deed of cancellation of the agreement to sell.
- Deed of Cancellation of Agreement to Sell (made below, with your kit details)
If both sides agree to call the deal off, sign the mutual rescission, which ends the agreement to sell by agreement.

If the seller is returning the advance, the seller signs the refund letter recording the amount, the date and the mode of payment.
- Refund of Earnest Money Letter (made below, with your kit details)
Once everything is settled, the side receiving the money signs a no-claim certificate saying it has no further claim on the deal or the property.

If the buyer is the one who backed out and the agreement allows it, the seller can send a notice that the advance is forfeited.
