What you will need
Use the papers in this order.
Before you start, both husband and wife collect these papers.
Have ready:
- The marriage certificate and the date and place of the marriage
- Both addresses, and the date from which you have lived apart
- ID proofs, and a list of any property and children to be settled
Agree and write down the settlement terms: what each side gets and gives up.

If you have children, write the child custody agreement.

Write the maintenance agreement for alimony and child support.

Last, make the joint petition for mutual divorce (first motion) and file it in the Family Court.

Only if you want to be heard sooner than the usual waiting period: make the application to waive the six-month period and file it with the first motion. Skip this step if you will wait.

When the court asks you to come back for the second motion, make the second motion petition and file it.
