What you will need

Use the papers in this order.

  1. Before you start, the lender and the borrower collect these papers.

    Have ready:

    • ID proof, address proof and PAN of both
    • The loan amount, the interest, the number and amount of EMIs and the date of the first EMI
    • The bank, branch and cheque details of the cheques the borrower will give as security

  2. Make the loan agreement with the EMI schedule and security cheques, sign it and have two witnesses sign.

  3. Make the promissory note (pronote) and have the borrower sign it, as the lender’s written proof of the debt.

  4. When the borrower gives the security cheques, make the security cheque handover letter listing them, and have both sign it.

  5. When the borrower pays, make the repayment receipt; on the last payment, make it as the final settlement and return the security cheques and the pronote.
