When you need it

Engaging a paid caretaker or chowkidar in PB/CH? Keys with nothing in writing is how owners lose control: occupation can turn hostile, starting the Limitation Act clock, and a caretaker can claim tenancy. This engages them for a wage, lists duties, states no tenancy or rent, and requires keys back within a fixed number of days.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No possession, no rent, no property interest — Article 5, Schedule I-A, Stamp Act 1899 (PB/CH), a small fixed sum. Stamp before signing (s.17). No exclusive possession/rent means no Article 35 lease duty.

Registration

Not compulsorily registrable — s.17 covers a property interest or lease; this is neither.

Notarisation

Not required. What matters is signing before the keys change hands.

Witnesses

Two witnesses — evidence against a tenancy claim.
