When you need it

As the recorded nominee for a bank account, society share, security or allotment, you make the asset-holder's death-claim application. Nomination lets an institution pay administratively, but its effect on ownership varies by statute — this letter does NOT claim the nominee always becomes final owner.

State the nomination, asset, death certificate, relationship and relief sought, reserving succession rights. Punjab cooperative-society shares: section 21, Punjab Co-operative Societies Act 1961 (Chandigarh: same Act, 1963 Rules). Chandigarh sector-property nominations sit in the Estate Office file instead. Keep the letter narrow.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab/Chandigarh: no stamp duty — a claim/request to the asset-holder, not an instrument assigning property rights.

Registration

Punjab/Chandigarh: not registrable (section 17, Registration Act 1908). A later property deed/transmission follows the law governing that asset.

Notarisation

Punjab/Chandigarh: not required unless the asset-holder’s claim process separately requires a sworn declaration.

Witnesses

Punjab and Chandigarh: No independent witness attestation is required for the claim letter; the nominee/claimant signs.

LEGAL BASIS

Punjab: For a Punjab cooperative-society share, section 21 of the Punjab Co-operative Societies Act, 1961 provides for transfer of the deceased member's share/interest to the person nominated in accordance with the rules or, absent nomination, to the heir/legal representative subject to the Act. For bank, securities, insurance or other assets, the governing asset statute/rules control nominee effect. The asset-holder receives the claim; the universal fee/timeline/appeal route was not confirmed.

Chandigarh: Section 21 of the Punjab Co-operative Societies Act, 1961 applies to UT Chandigarh cooperative societies through the 1963 Rules. Other nominated assets follow their own national/sectoral law. For Chandigarh sector property, an Estate Office nomination/transmission record is separate. The universal fee/timeline/appeal route was not confirmed from the sources used.
