Darkhwast Nishandehi (Application for Demarcation of Land)

Answer what you can. The draft beside these boxes is rewritten as you go, so you can see exactly what each answer does to the document.

What you type stays in this browser. Moving to a new step asks this site to draw it, but nothing is kept anywhere until you choose to keep a copy — and closing this tab loses it.

Your answers

Nothing answered yet. There are 8 questions on this form.

Still to answer

7 answers are still to come.

Nothing is amiss in what you have written. The document is simply not finished, and the draft marks each gap where an answer will go.

  1. The applicant
  2. The land and how the interest arose
  3. The demarcation and its boundaries
  4. Related matters
  5. Date, place and filing

Step 1 of 5

The applicant

For example: Gurpreet Singh

Relationship shown in the recordNeeded

For example: Sardar Joginder Singh

A plain number. Digits only — no words and no units beside them.

For example: 47

Full postal address of the applicantNeeded

A number somebody can be reached on. Ten digits is the usual Indian form, and a country code in front of it is fine if you want it there.

For example: +91 XXXXX XXXXX

In what capacity is the applicant applyingNeeded
More details — you may leave these

An email address somebody actually reads. Notices under a document like this can be sent to it, so a working one matters more than a tidy one.

For example: gurpreet.singh@example.com

Clearing empties every box on this form, and there is no way back to what was in them.

Document language

This is the document as far as you have reached, not the whole of it yet — the rest appears as you answer more questions. It is rewritten every time you change an answer.

A long blank line — __________ — stands wherever an answer has not been given. It is left that visible on purpose, so an unfinished document cannot be mistaken for a finished one.

No answer has been given, so every place a detail belongs is standing blank. The shape of the document is worth reading even now.

DARKHWAST NISHANDEHI
(APPLICATION FOR DEMARCATION OF LAND)

Demarcation Case No. ______________ of 20______
(to be filled in by the office)

APPLICANT:
__________, __________ __________, resident of __________.
Mobile: __________

VERSUS

RESPONDENTS:
The adjoining khasra holders named in Part C of this application, and all other persons interested.

APPLICATION FOR DEMARCATION (NISHANDEHI) OF THE BOUNDARIES OF THE ABOVE-DESCRIBED LAND AND FOR THE ERECTION OF BOUNDARY PILLARS (BURJIS), MADE UNDER CHAPTER IX (BOUNDARIES AND BOUNDARY MARKS) OF THE PUNJAB LAND REVENUE ACT, 1887, READ WITH THE NOTIFIED SERVICE OF LAND DEMARCATION UNDER THE PUNJAB TRANSPARENCY AND ACCOUNTABILITY IN DELIVERY OF PUBLIC SERVICES ACT, 2018

RESPECTFULLY SHEWETH:

PART A — THE APPLICANT AND HIS INTEREST IN THE LAND

PART B — THE OCCASION FOR DEMARCATION

PART C — THE ADJOINING HOLDERS TO BE SUMMONED

  1. 9. That the applicant undertakes to bear the cost of service of notice upon each of the said adjoining holders, to assist the process server in effecting service, and to remain personally present, or to be duly represented, upon the date and at the hour that may be fixed for the spot inspection, together with the original title documents and the revenue papers relating to the said land.

PART D — THE PROCEDURE PRAYED FOR AND THE APPLICANT'S UNDERTAKINGS

  1. 12. That the applicant is conscious, and expressly states, that this application seeks only the fixing upon the ground of the boundaries which the revenue record already shows, and does not seek, and cannot result in, any adjudication of title. The applicant further states that under section 44 of the Punjab Land Revenue Act, 1887 an entry in a record-of-rights or annual record is presumed to be true only until the contrary is proved or a new entry is lawfully substituted for it, and that any question of title falls to be determined by the civil court in a suit for a declaratory decree, to which section 45 of that Act directs the aggrieved party.
  1. 13. That this application is made bona fide, in the interest of justice, and not with any intention of harassing the adjoining holders or of disturbing any settled possession.

PRAYER

It is therefore most respectfully prayed that this Court may graciously be pleased to:

(a) register this application and issue summons to the adjoining khasra holders named in Part C above, and to any other person appearing to this Court to be interested in the said boundaries;

(c) direct that boundary pillars (burjis) be erected at the corners and turning points of the said land, and that the demarcated boundaries be recorded upon a tatima shajra prepared for the purpose;

(d) direct that the demarcation report of the Field Kanungo, together with the tatima shajra, be placed upon the revenue record of the estate, and that a certified copy of both be supplied to the applicant upon payment of the prescribed copying fee;

(e) pass such further or other order as this Court may deem fit and proper in the facts and circumstances of the case.

And for this act of kindness the applicant shall, as in duty bound, ever pray.

SCHEDULE OF THE LAND TO BE DEMARCATED

BOUNDARIES OF THE SAID LAND

LIST OF DOCUMENTS ANNEXED

I, __________, __________ __________, resident of __________, the applicant above named, do hereby verify that the contents of paragraphs 1 to 13 of this application, and of the Schedule, the statement of boundaries and the list of documents annexed, are true and correct to my knowledge derived from the revenue record and from my own inspection of the land, that nothing material has been concealed and that no part of it is false.

AFFIDAVIT IN SUPPORT OF THE APPLICATION FOR DEMARCATION

[PRINT THIS AFFIDAVIT ON STAMPED PAPER TAKEN OUT IN THE NAME OF THE DEPONENT, AND NOT ON THE PLAIN SHEET THE APPLICATION IS PRINTED ON. An affidavit is a chargeable instrument under Article 4 of Schedule I-A of the Indian Stamp Act, 1899 as applied in Punjab, and bears a fixed nominal duty which does not scale with the value of the land. Because that duty is a small denomination it is ordinarily paid on conventional non-judicial stamp paper bought from a licensed stamp vendor: Stock Holding Corporation of India Limited, the Central Record Keeping Agency for Punjab, issues e-stamp certificates for amounts exceeding Rs 49,999, under Punjab Revenue Department Notification No. 24/201/07-ST.2 dated 30 October 2014. A digital route exists for this very document — National e-Governance Services Limited is an Authorised Collection Centre under rules 2(c), 12 and 13 of the Punjab E-Stamp Rules, 2014 and issues dematerialised e-stamps for an affidavit or declaration. Ask the licensed stamp vendor in the Tehsil complex, or the Sub-Registrar's counter, for the denomination in use before you print. The application itself bears no stamp duty at all and belongs on plain paper.]

I, __________, __________ __________, aged __________ years, resident of __________, do hereby solemnly affirm and declare as under:

  1. 1. That I am the applicant in the accompanying application for demarcation and am __________, and am competent to swear this affidavit.
  1. 5. That the persons whose holdings adjoin the said land, and whom I have named in the accompanying application so that they may be summoned, are all of the adjoining holders known to me, and I have concealed the name of no such person.
  1. 6. That save as disclosed in the accompanying application, no suit, appeal, revision or other proceeding concerning the title to, or the boundaries of, the said land is pending before any civil court or revenue court, and no such proceeding has been decided against me.
  1. 7. That save as disclosed in the accompanying application, no demarcation of the said land has previously been carried out by the revenue agency.
  1. 8. That I undertake to remain present, or to be duly represented, upon the date fixed for the spot inspection, and to bear the prescribed fee together with the travelling and daily allowance of the revenue staff, the wages of the labour, and the cost of the boundary pillars erected.
  1. 9. That I understand that the demarcation prayed for will fix upon the ground only such boundaries as the revenue record discloses, that it will not confer or determine any title, and that any question of title is liable to be decided by the civil court.
  1. 10. That the contents of the accompanying application and of this affidavit are true and correct to my knowledge, that nothing material has been concealed and that no part of them is false.

Reading costs nothing. Keeping a copy needs an account.

The opening of the draft is on this page as you answer it. Once every answer is in, the button below opens the whole draft, watermarked — still without an account. Printing it, or keeping a clean copy, is where an account is asked for. That is the whole arrangement.

A kept copy has to belong to somebody, and that is the reason for the account. There is nothing further to it.
