LEGAL BASIS
Punjab: The application is made under section 6(1) of the Right to Information Act, 2005, and section 6(2) requires no reason for it. It is received by the State Public Information Officer of the public authority, its addressee, who decides it under section 7(1) within thirty days of receipt, or within forty-eight hours where the life or liberty of a person is concerned; five days are added under the proviso to section 5(2) where a State Assistant Public Information Officer receives it, and section 7(2) treats silence as a refusal. Rule 3 of the Punjab Right to Information Rules, 2017 fixes the application fee at ten rupees and asks that an application not exceed five hundred words, excluding annexures, while forbidding its rejection on that ground alone; rule 4 charges two rupees for each page in A-3 or smaller size and nothing for the first hour of inspection; rule 5 exempts a person below the poverty line from fees up to fifty rupees under rules 3 and 4 on a copy of the certificate issued by the appropriate Government; and rule 6 takes payment in cash against a proper receipt, by demand draft, banker's cheque or Indian Postal Order payable to the Accounts Officer of the public authority, or by electronic means where the public authority has that facility. An appeal against the decision, or against its absence, lies under section 19(1) within thirty days to the First Appellate Authority, the officer senior in rank to the State Public Information Officer, and a second appeal under section 19(3) within ninety days to the Punjab State Information Commission.
Chandigarh: For a public authority under the Union Territory of Chandigarh Administration, section 2(a)(i) of the Right to Information Act, 2005 makes the Central Government the appropriate Government, so the Right to Information Rules, 2012, notified as G.S.R. 603(E) on 31 July 2012, govern the application. It is received by the Central Public Information Officer of the public authority, its addressee, who decides it under section 7(1) within thirty days of receipt, or within forty-eight hours where the life or liberty of a person is concerned; five days are added under the proviso to section 5(2) where a Central Assistant Public Information Officer receives it. Rule 3 of the 2012 Rules fixes the application fee at ten rupees, with the same five-hundred-word request and the same bar on rejection for length; rule 4 charges two rupees for each page in A-3 or smaller size; rule 5 exempts a person below the poverty line from the fees under rules 3 and 4 on a copy of the certificate issued by the appropriate Government; and rule 6 allows the same three modes of payment. An appeal lies under section 19(1) within thirty days to the First Appellate Authority, and a second appeal under section 19(3) within ninety days to the Central Information Commission.
