When you need it

The landlord will proceed only if another person backs defined payment obligations. A proper guarantee identifies the tenancy, states what it covers, sets a cap and end date, and addresses later rent/term changes. The Contract Act, 1872 governs guarantee and suretyship, so vague wording can expose a guarantor more broadly than expected.

It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

GUARANTOR AGREEMENT FOR A TENANCY

Date: 2 April 2026

Related tenancy dated 1 April 2026 for Flat 602, Homeland Heights, Sector 70, SAS Nagar, Punjab between Rajiv Khanna, of House 214, Sector 8-B, Chandigarh, and Amanpreet Singh, of House 88, Phase 7, SAS Nagar, Punjab. Landlord mobile: +91 XXXXX XXXXX. Tenant mobile: +91 XXXXX XXXXX..

  1. 1. Guarantor

The guarantor is Vikram Singh, of House 19, Sector 16, Chandigarh, mobile +91 XXXXX XXXXX.

  1. 2. Guarantee

The Guarantor guarantees: Rent, documented tenant dues and tenant-caused damage under the identified tenancy. The maximum contractual exposure under this guarantee is ₹3,00,000 (Rupees Three Lakh only). The guarantee ends on 2 April 2026, subject to claims arising from obligations that fell due before that date and were notified within the ordinary reconciliation process.

This is a secondary payment/security obligation connected to the identified tenancy. It does not make the Guarantor an occupier or tenant and does not give the Guarantor possession rights.

  1. 3. Demand and proof

A demand should identify the amount claimed, the tenancy obligation said to be unpaid or breached, and the supporting rent ledger, bill, inspection record or other reasonable evidence. A due guaranteed amount is payable within 7 days after a compliant written demand.

  1. 4. Changes to tenancy

Variation rule: A material increase in term, rent or guaranteed exposure requires the guarantor’s written consent. A replacement tenancy, extension, substantial rent increase outside the disclosed escalation, or expansion of guaranteed obligations should not silently enlarge the Guarantor’s exposure beyond the selected rule.

  1. 5. Possession remedies remain separate

This guarantee secures payment/defined loss only. It does not authorise the Guarantor or Landlord to evict, exclude or seize property. Possession is governed by the tenancy and the competent Punjab or Chandigarh rent-law process.
