Stamp duty
No stamp duty is chargeable on this Agreement as a conveyance.
Registration
Not registrable under the Registration Act, 1908. s.17 of that Act reaches instruments concerning immovable property and specified transactions; a sale of a motor vehicle is not among them, and this Agreement is not presented to any Sub-Registrar.
Witnesses
Not legally required for a private sale of movable property, but two witnesses are customary for a transaction of this value and are provided for below, since a tractor sale disputed later is commonly disputed on exactly the facts a witness can speak to — what was said about the machine's condition and what was actually paid.

When you need it

A private sale of a used tractor, with or without its trolley and implements, between a seller and a buyer in Punjab or Chandigarh. Records the price and payment, the condition the Buyer is taking the Tractor in, whether any financier still holds a hypothecation over it, and who is responsible for transferring the registration certificate into the Buyer's name at the RTO.

A tractor is a motor vehicle under the Motor Vehicles Act, 1988 even though it needs no permit for ordinary agricultural use, and it stays registered in the Seller's name — with every challan, tax demand and third-party claim that follows a registered owner — until Form 29 and Form 30 are filed and the transfer of ownership is recorded under s.50 of that Act. Unlike a house or a plot, no stamp duty or registration under the Registration Act, 1908 turns on this sale: the price and delivery are governed by the Sale of Goods Act, 1930, and the RTO entry, not a registered deed, is what actually changes who is accountable for the vehicle. Not for: a new tractor bought from an authorised dealer, which comes with the dealer's own invoice, warranty and finance paperwork; a tractor bought entirely on a bank or NBFC loan disbursed directly to a dealer, where the financier's own documentation governs; or a sale where the trolley or implements are being sold separately from the tractor to a different buyer.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is chargeable on this Agreement as a conveyance. Duty on a "Conveyance" under Schedule I-A as applicable to Punjab, and under the corresponding Chandigarh schedule, is charged on an instrument transferring an interest in immovable property or specified categories of movable interest; a straightforward cash sale of a tractor, completed by delivery, is a sale of goods under the Sale of Goods Act, 1930 and is not itself chargeable. This Agreement is accordingly prepared on plain paper. The step that actually matters is not stamping but the RTO transfer: Form 29 and Form 30 under the Central Motor Vehicles Rules, 1989, filed with the registering RTO under s.50 of the Motor Vehicles Act, 1988, together with the RTO's own transfer fee — a separate, small statutory fee that has nothing to do with stamp duty and is paid at the RTO, not to either party. If either party is asked at some other office to produce a stamped instrument of sale, ask that office which article of the Stamp Act it says applies before buying stamp paper on the strength of the request alone; no article aimed specifically at an unaccompanied bill of sale for a vehicle has been identified for Punjab or Chandigarh, and paying duty that is not actually chargeable does not protect either party.

Registration

Not registrable under the Registration Act, 1908. s.17 of that Act reaches instruments concerning immovable property and specified transactions; a sale of a motor vehicle is not among them, and this Agreement is not presented to any Sub-Registrar. "Registration" of the Tractor itself is a different thing under a different Act: the vehicle's registration certificate is held with the RTO named in Schedule I, and s.50 of the Motor Vehicles Act, 1988 requires the transfer of ownership to be reported and recorded there — the transferor within fourteen days of the transfer, on Form 29, and the transferee applying for the entry to be made in their name on Form 30, with the fee the RTO prescribes. Until that entry is made, the Seller remains the registered owner of record for every purpose that depends on the RTO register, whatever this Agreement says between the parties.

Notarisation

Not required for this Agreement. Form 29 and Form 30 are filed in whatever format the RTO currently prescribes, which may call for the signatures to be attested; follow that form's own requirement rather than notarising this Agreement in its place.

Witnesses

Not legally required for a private sale of movable property, but two witnesses are customary for a transaction of this value and are provided for below, since a tractor sale disputed later is commonly disputed on exactly the facts a witness can speak to — what was said about the machine's condition and what was actually paid.
