When you need it

Buying via a PB/CH dealer? Most dealers work for the seller while advising you. This makes the agent yours: records your brief/budget, requires acting in your interest, and disclosure before any offer if a seller also pays it.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Appointing a buyer's agent, no property interest — Article 5, Schedule I-A, Stamp Act 1899 (PB/CH), a small fixed sum. Stamp before signing (s.17); Sub-Registrar/e-stamp vendor gives the figure; Collector adjudicates (ss.31-32).

Registration

Not registrable: s.17, Registration Act, 1908 needs a Rs 100+ property interest created; this creates none. Optional under s.18, pointless.

Notarisation

Not required — the witnesses already establish who signed.

Witnesses

Not required by law; two are recommended — disputes turn on what was agreed.

Background

A. The Buyer wishes to buy a property in Punjab and has asked the Agent to find one and to act for the Buyer in buying it.

B. The Agent accepts that, in doing so, it acts for the Buyer and not for any seller.

1. The brief

1.1 The Buyer is looking for: A three-bedroom independent floor or house of at least 1,500 square feet, with parking for two cars

1.2 In or near: Sectors 66 to 70 and Aerocity, SAS Nagar (Mohali); failing those, Kharar

1.4 The Agent is engaged from 2 April 2026 to 3 April 2026 ("the Engagement Period"). The Buyer will not engage any other agent to search for a property of this description during the Engagement Period.

2. The Agent acts for the Buyer

2.1 The Agent will act in the Buyer's interest in finding, assessing and negotiating for a property, and will try to obtain it on the best terms available.

2.2 The Agent will not tell any seller, developer or seller's agent the Buyer's maximum budget, the Buyer's reasons for buying, or anything else about the Buyer's position that could weaken it in negotiation, without the Buyer's consent.

2.3 The Agent will tell the Buyer everything it knows or learns that bears on a property's value or on whether the Buyer should buy it, including any dispute, tenancy, charge, unauthorised construction or defect.

2.4 The Agent will not buy, or let a relative or associate buy, a property it has found for the Buyer, and will tell the Buyer at once if it has any interest in a property it shows.

3. Payments from anyone else

3.1 The Agent will not accept any payment from any seller, developer or other agent in connection with a property it shows the Buyer.

3.2 Where a property is in a project registered with a Real Estate Regulatory Authority, the Agent will deal in it only if the Agent is itself registered as a real estate agent.

4. The Agent's fee

4.1 The Agent's fee is 1 per cent of the purchase price actually agreed for a property the Agent introduced to the Buyer.
