No-Claim Certificate on a Cancelled Sale

At a glance

Price
Free
Stamp duty
Does two chargeable things: acknowledges money received (a receipt, Art.53 Sch.I — ₹1 revenue stamp over ₹5,000, same in Punjab/Chandigarh) and renounces claims (a release, Art.55 Sch.I-A); s.6 charges the higher duty, so stamp as a release.
Registration
Not needed for a limited acknowledgment that doesn’t extinguish registrable property rights; a substantive rights release needs a separate registered instrument.
Witnesses
Witnesses are optional, though useful for a significant settlement.

When you need it

Use once a cancelled sale's refund and settlement are complete, to certify which claims are discharged: the transaction, refund reference, and what's released vs reserved — avoid a sweeping 'no claim of any kind', which can waive unrelated brokerage/tax/fraud issues. Make the release conditional if a step is pending.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

No published table prices this — ask the Sub-Registrar (or UT Chandigarh, Sector 17) or get it adjudicated (s.31). Giving up a property share, not money claims, can be charged ad valorem as a conveyance. Unstamped: inadmissible until duty and penalty are paid (s.35).

Registration

Not needed for a limited acknowledgment that doesn’t extinguish registrable property rights; a substantive rights release needs a separate registered instrument.

Notarisation

Notarisation is not required merely for the certificate.

Witnesses

Witnesses are optional, though useful for a significant settlement.
