When you need it

Use this one for a specifically agricultural holding, including formally affirming a partition already carried out privately in the past (section 123); use the Application for Partition (Taqseem) of a Joint Holding instead for the general version covering any jointly-held jamabandi land, with a choice of the contested or consent route and an oral-partition memorandum option. A recorded co-sharer wants revenue authorities to divide an agricultural holding, or an earlier private partition formally affirmed.

Chapter IX, Punjab Land Revenue Act 1887: section 111 the application, sections 112–120 notice/parties/title/distribution, section 121 the instrument of partition, section 122 possession, section 123 affirms a private partition. Appeal (sections 13–14): Assistant Collector to Collector to Commissioner to Financial Commissioner, 30/60/90 days. Not for a Chandigarh sector plot; for Chandigarh revenue-village land, confirm the current UT law first.

LEGAL BASIS

Punjab: Chapter IX of the Punjab Land-Revenue Act, 1887 governs partition. Section 111 is the application provision; sections 113-118 cover notice, parties and title/other questions; section 121 provides the instrument of partition, section 122 delivery of possession and section 123 affirmation of private partition. Appeals are under section 13, with section 14 limitation of 30, 60 and 90 days according to the appellate level. Exact partition fee/cost schedule was not confirmed.

Chandigarh: This template is not for sector/estate property. For Chandigarh revenue-village land, the precise partition statute, empowered Revenue Officer, fee and appeal route were not confirmed and must be inserted before filing. Sector property belongs to the Estate Office under the 1952 Act/2007 Rules.
