When you need it

Use this one for a generic release of an undivided share between existing co-owners, not necessarily tied to a death or inheritance; use the Relinquishment Deed (Haq Tyag) instead where a co-owner is releasing an inherited share after a death and needs the Punjab/Chandigarh mutation process spelt out, Relinquishment of an Inheritance if the share is already a vested, recorded inheritance, or Quit Claim Deed for Family Property if the claim itself is disputed or uncertain. A co-owner gives up their undivided share to another EXISTING co-owner — not a sale to a stranger; the releasor's right is extinguished, enlarging the other's interest (Article 55; section 17(1)(b), Registration Act 1908).

State the releasor's and releasee's shares, consideration, encumbrances and post-release title. No pre-existing releasee interest with a real price paid may need conveyance treatment instead. Punjab authority property stays subject to section 43(7); Chandigarh needs an Estate Office update after registration.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 55, Schedule I-A, Indian Stamp Act 1899 — duty is remitted IN WHOLE on a lifetime transfer to a "blood relation" (child, grandchild, brother, sister; parent/spouse NOT covered — Order S.O.28/C.A.2/1899/S.9/2014); otherwise no published rate — ask the Sub-Registrar. Duty runs on consideration or Collector rate, whichever higher. Chandigarh: blood-relation transfers are exempt; its calculator shows Rs 15 (simple release) or 8%/6% (unancestral, in/outside MC area) — confirm first. Stamp at signing (section 17); understamped, inadmissible until cured (section 35).

Registration

Compulsorily registrable under section 17(1)(b); present within four months (section 23). Fee: Punjab 1% (min Rs 50, max Rs 2,00,000) plus Rs 200 pasting; Chandigarh 1% capped at Rs 10,000 plus Rs 20 pasting.

LEGAL BASIS

Punjab: Article 55 classifies a release. Because this deed extinguishes a co-ownership right in immovable property, section 17(1)(b) requires registration; section 23 gives four months. For Punjab development-authority property, section 43(7) requires previous permission. The stamping note sets out the Article 55 position, including the Punjab blood-relation remission, and the registration note gives the fee.

Chandigarh: Article 55 and section 17(1)(b) apply to the immovable-property release. Sector property must then be reflected in the Estate Office file under the 1952 Act/2007 Rules. The stamping and registration notes give the Chandigarh lines.
