When you need it

The owner/allottee died without a will, and heirs need the property authority to transmit the recorded interest under intestate succession law — kept separate from the local record system. Punjab revenue/freehold property needs revenue/registration action; a development-authority allotment sits in the allottee file.

Chandigarh sector property transmits through the Estate Office file (Capital of Punjab (Development and Regulation) Act 1952; Chandigarh Estate Rules 2007) — not a Punjab jamabandi request; only Chandigarh revenue-village land uses revenue records. Shares may arise under the Hindu Succession Act 1956 or another regime; a disputed heir/will needs a court order. This records transmission only, not a release/partition bargain.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab/Chandigarh: no stamp duty — asks the record authority to reflect succession, not a voluntary transfer deed.

Registration

Punjab/Chandigarh: not registrable (section 17, Registration Act 1908). A release, partition or conveyance rearranging heir shares is a separate registrable/stampable instrument.

Notarisation

Punjab/Chandigarh: not part of the request itself; authority-demanded affidavits are separate sworn documents.

Witnesses

Punjab and Chandigarh: No attesting witnesses are required for this transmission application; the claimant signs.

LEGAL BASIS

Punjab: Intestate shares arise under the personal succession law applicable to the deceased; for Hindus/Buddhists/Sikhs/Jains, the Hindu Succession Act, 1956 is the principal intestacy statute. The receiving office is the Punjab revenue authority for revenue-record land or the relevant development authority for its allotment file. The exact fee, timeline and appeal route for the selected transmission service were not confirmed from the sources used. For land in the revenue record, section 34 of the Punjab Land Revenue Act, 1887 requires a person who succeeds to report the acquisition to the Halqa Patwari of the estate, and section 39 makes one who neglects to report within three months liable, at the discretion of the Collector, to a fine of up to five times the mutation fee.

Chandigarh: Intestate shares arise under the applicable substantive succession law. For a sector/estate property, the Estate Officer maintains the property file under the Capital of Punjab (Development and Regulation) Act, 1952 and Chandigarh Estate Rules, 2007; there is no jamabandi/fard/mutation for a sector property. The exact Estate Office transmission fee, timeline and appeal route were not confirmed from the sources used.
