When you need it

The sworn affidavit that goes with that application — on stamp paper and notarised, for the PSPCL or Chandigarh office that will not move a connection on the application alone. A domestic, commercial or industrial electricity connection has to move into a new name — because the person it stood in has died, because the premises it serves have been sold or let to someone else, or because another member of the same household is taking it over — and the distribution licensee (PSPCL in Punjab, or the department supplying electricity to Chandigarh) asks for an affidavit alongside its own name-transfer or mutation-of-connection form before it re-registers the account.

The library also carries the Application for Transfer of Electricity Connection (Change of Name), which is the formal application used where the transfer follows a property mutation. This affidavit is the general sworn declaration a distribution office asks for alongside that application, or on its own for a same-household takeover that involves no mutation. Not for a first application for a new connection, which is a different form; for reconnection after disconnection for non-payment, which the office handles as a separate process; or a change of tariff category alone, without a change of the name the connection stands in.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

An affidavit is chargeable under Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, which Schedule also governs the Union Territory of Chandigarh, and most distribution offices also ask for an indemnity, which Article 34 of the same Schedule charges at the rate fixed for a security bond. In practice distribution offices accept this combined affidavit-cum-indemnity on a single non-judicial stamp paper of a nominal value the office's own name-transfer form specifies — ask the sub-division office which value it wants before buying the stamp paper.

Registration

This affidavit is filed with the distribution office for its own record and is not an instrument the Registration Act, 1908 requires to be registered, in Punjab or in Chandigarh. Keep the office's acknowledgement of the transfer request.

Notarisation

Distribution offices in both jurisdictions commonly ask for this affidavit to be notarised before a Notary Public or an Oath Commissioner; some accept a self-attested declaration instead for a transfer within the same household — confirm which the particular office wants before the appointment.

Witnesses

The distribution office's own transfer form, not this affidavit, is where a witness or the outgoing consumer's own signature of consent is asked for, if at all; this affidavit needs no separate witness in either jurisdiction beyond the notarial attestation.
