When you need it

An owner died leaving a will; the beneficiary wants the record updated: deceased, date of death, will date, beneficiary, identifiers, share claimed. Mutating isn't proving the will — if genuineness, capacity or heir objections are disputed, the authority may need more evidence or leave parties to court.

A contested will isn't self-proving; mutation isn't a conclusive title adjudication.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty: a s.34 mutation report transfers nothing (outside Schedule I-A); duty was due on the source instrument. No court fee. Cost is the Rs 600 mutation fee (Punjab Revenue Dept, 6 Sep 2026), recovered under s.38(2) at attestation from the person favoured; late reporting (past 3 months) risks a s.39 fine up to 5x — Rs 3,000.

Registration

Not registrable — outside s.17, Registration Act, 1908. The Patwari logs it in the register of mutations, the Kanungo validates it, returning an intkal number and order. An unregistered instrument needing registration can't found a mutation.

Notarisation

Not required unless the authority asks for an affidavit, declaration or attested copy.

Witnesses

Not ordinarily required; the authority may call for witnesses or identifiers at attestation or hearing.

The request is confined to mutation on the testamentary basis presented. If the will, heirship, capacity, execution or competing testamentary claim is disputed, the mutation authority should follow the lawful hearing/evidence route rather than treat this application as conclusive proof of the will.

HEIRS AND OBJECTIONS

Known objection/competing-claim status: No known objection has been communicated.

REQUEST

Please consider the testamentary record, affected-heir notice requirements and the existing record of rights, and decide the mutation accordingly.

LEGAL BASIS

In Punjab this application is the report of a change in rights under section 34 of the Punjab Land Revenue Act, 1887. It is addressed to the Circle Revenue Officer through the Halqa Patwari of the revenue estate, and can be handed to the Patwari or lodged at the Fard Kendra of the tehsil or sub-tehsil; the Halqa Patwari enters it in the register of mutations, the Field Kanungo validates the entry, and the Circle Revenue Officer, a Naib Tehsildar or Tehsildar, attests, sanctions or rejects it. A mutation records a change of rights; it does not create title. An entry in the record of rights is presumed true only until the contrary is proved (section 44 of the Act), and section 45 sends anyone who disputes it to a civil suit for a declaration. In Chandigarh only the Union Territory's revenue villages carry a jamabandi; there the Patwari holds the record of rights and the Tehsildar or Naib Tehsildar of the Union Territory attests the mutation. A sector property held from the Estate Office has no jamabandi and is not mutated this way: the Estate Office's own transfer procedure applies.
