To,
The Sub Divisional Magistrate,
S.A.S. Nagar (Mohali), Punjab.
Subject: Encroachment upon the common passage adjoining House No. 1024, Phase 7, S.A.S. Nagar
Respected Sir / Madam,
- 1. That the complainant, Balwinder Singh, S/o Sh. Gurdev Singh, aged about 54 years, resident of House No. 1024, Phase 7, S.A.S. Nagar (Mohali), contact number 98765 43210, most respectfully begs to submit this complaint as under.
- 2. That this complaint concerns: The common passage, four feet wide, running along the eastern boundary of House No. 1024 and House No. 1026, Phase 7, S.A.S. Nagar (Mohali), shown as such in the site plan sanctioned by GMADA.
- 3. That the complaint is made against Jaswinder Singh, resident of House No. 1026, Phase 7, S.A.S. Nagar (Mohali), and relates to encroachment upon or obstruction of a public street, passage or common land.
- 4. That the facts of the matter are as follows: On or about 2 August 2026, the respondent raised a permanent brick wall across the common passage referred to above, blocking access that the complainant and other residents of the lane have used without obstruction for over fifteen years. Repeated requests to remove the wall, made verbally and in writing on 5 and 12 August 2026, have not been complied with.
- 5. That the matter is urgent for the following reason, and an interim order is prayed for pending final disposal: the obstruction prevents emergency and essential-service vehicles from reaching the complainant's house, and an interim direction is prayed for pending final disposal
- 6. That this complaint is made bona fide and in the interest of justice, and that no earlier representation on the same facts is pending before this or any other authority except as stated above.
It is, therefore, most respectfully prayed that this Hon'ble authority may kindly direct removal of the unauthorised construction obstructing the common passage, restore the passage to its former condition, and take such action against the respondent as the facts warrant, and pass such other order or orders as may be deemed fit in the interest of justice.
- 1. Photographs of the obstruction, dated 3 August 2026.
- 2. Copy of site plan sanctioned by GMADA.
- 3. Copies of written requests dated 5 and 12 August 2026.
This is a written representation to the executive and revenue authority having local jurisdiction, made under the general right of a citizen to petition a public authority. Where the facts concern an apprehended breach of the peace or a public nuisance, they are capable of being considered under the preventive and nuisance provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023; where they concern land records, under the Punjab Land Revenue Act, 1887 as applicable in Punjab and Chandigarh. This representation does not itself decide, and is not capable of deciding, any question of title to immovable property — that is a matter only a competent civil court can determine.
