When you need it

The landlord agrees to waive all or part of the financial consequence of ending the tenancy during a lock-in. The waiver states what's forgiven, what (if any) remains payable, and whether it depends on a replacement tenant.

It preserves unrelated dues unless expressly released.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty — a tenancy-fact record, not a leasehold interest. Repurposed into a fresh term or surrender for value, stamp accordingly.

Registration

Not compulsory unless it creates a registrable interest — a lease over a year or yearly rent is, under s.17(1)(d).

Notarisation

Not required; doesn't replace registration — a dated signature matters more.

Witnesses

Optional, prudent for a large waiver.

LOCK-IN PERIOD WAIVER LETTER

Date: 3 April 2026

Under Registered Rent Agreement dated 01 April 2026 for House 118, Sector 35-A, Chandigarh, commencing 1 April 2026, between Harpreet Singh and Aarav Sharma, the original lock-in is 12 months, ending 2 April 2026.

The Landlord agrees that the Tenant may exit on 4 April 2026 subject to the terms below.

Waiver scope: All remaining lock-in rent/penalty is waived if the stated exit conditions are met. Amount still payable: ₹0 (Rupees Zero only). Basis: No exit charge.

Notice treatment: Existing notice period continues unchanged.

Deposit treatment: Deposit remains subject to ordinary final settlement and deductions.

Replacement-tenant condition: No replacement tenant condition applies.

Other breaches/dues: Unrelated accrued breaches and dues remain subject to settlement.

This waiver is limited to the lock-in consequences expressly stated and does not by itself settle deposit, utilities, damage or possession unless those matters are expressly included.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023. Personal data in this document is collected only to record and administer the landlord's agreed waiver of specified lock-in consequences for the tenant's early exit, communicate about that purpose, verify the information expressly supplied, and retain an evidentiary record.

The record will be held by Harpreet Singh and may be shown only to the landlord, tenant, authorised property manager or property consultant involved in the tenancy, a bank/payment service provider where settlement requires payment, a society or utility provider where final handover requires closure, and a statutory authority where disclosure is required for the transaction recorded here.

If this transaction does not proceed, or this document is withdrawn before it takes effect, the personal data will be retained for 90 days from that decision and then erased. If it proceeds, the record will be retained for the term of the tenancy or transaction plus 12 months and then erased, except for a record that a statute requires to be kept for a longer named period.

A person named in this document may withdraw consent for future consent-based processing, request correction or erasure when the stated purpose has ended, or raise a grievance by writing to support@kagaznama.com. The record-holder should acknowledge and respond within 30 days.

Data minimisation: this document deliberately does not require a full Aadhaar number, Aadhaar-card copy, PAN, bank-account credentials, passwords or unrelated identity material. Detailed identity verification belongs in the separate KYC process.

Personal-data instruction: I consent to the collection and use described in the Personal Data Notice.
