NOC in Punjab and Chandigarh: landlord, co-owner and Estate Office letters

A No Objection Certificate (NOC) is a short signed letter in which the person whose consent an office wants to see, such as a landlord, a co-owner, a housing society or the Estate Office, says in writing that they do not object.

The common ones in Punjab and Chandigarh are a landlord’s NOC for a tenant’s address proof or a utility connection, an owner’s NOC for a GST or company registration, a co-owner’s consent before a sale, and the Estate Office’s permission to transfer a Chandigarh leasehold.

Most carry no stamp duty and none has to be registered, but some offices ask for notarisation even where the law does not, so ask the office what it wants before you sign.

Checked on against the stamp, registration and notarisation notes on each NOC’s page. Those pages carry no check date of their own, apart from the Chandigarh deed duty, which was read from the Administration’s own calculator on 6 September 2026. Confirm each Chandigarh figure at the Sub-Registrar; for every other NOC, the office asking for it decides what it will accept. Guide updated .

What does a landlord’s NOC cover?

The Landlord NOC for Tenant’s Address Proof confirms that a tenant lives at the rented premises, for a passport, an Aadhaar address update or bank KYC. It is not a tenancy agreement and creates no tenancy right; for a new tenancy see our rent agreement guide.

A landlord’s NOC for an electricity, water or gas connection lets the provider install it. State the exact request and its limits, not an open-ended consent. It is not proof of ownership, or of a tenancy beyond its term.

None of these carries stamp duty, because each is a permission record and not a leasehold interest, and none needs registration. Notarisation is ordinarily not required, though some authorities ask for it, so check what the application asks.

What about an NOC for GST or a business registration?

The Landlord’s NOC for GST or Company Registration at the Premises is the owner’s no-objection to a business registering a shop, office, godown or industrial plot as its GST place of business or registered office. It is not for a home address. Every co-owner must sign: one of two joint owners signing is routinely rejected at the GST desk and by the Registrar of Companies.

When do you need a co-owner’s consent NOC?

When a Punjab or Chandigarh property is sold, gifted, mortgaged, leased or handed to a developer and the person dealing is not the only one with a claim, the advocate, bank, Sub-Registrar or Estate Office wants the rest of the family’s written no-objection: the NOC and Consent of Co-owners and Co-sharers (Raza Nama).

In Punjab the khewat usually decides: where it shows two or more names, an objecting co-sharer can stall the intkal for years. In Chandigarh, since the Public Notice of 10 February 2023, a multi-owner residential property can be dealt with only in four categories. Whether that restriction has lifted is unresolved on our pages, so ask the Estate Office first.

Nothing binds a person who has not signed. A pure consent transfers nothing and falls to the residuary stamp article, a fixed sum: get the figure first from the Sub-Registrar or an e-stamp vendor. If the wording releases or surrenders a share, or money changes hands, it can be charged as a release on the share’s value. It is not compulsorily registrable, and notarisation is not required by law but is routinely wanted.

What is the Estate Office NOC in Chandigarh?

Before you sell, gift, exchange or transfer within the family a Chandigarh leasehold or concessionally allotted site, you apply to the Estate Office for permission, with our Estate Office NOC application (Annexure-1). The Sub-Registrar will not register the transfer deed without it, and one-third of the unearned increase must be assessed and paid first.

The application is on plain paper with no stamp duty, and every recorded lessee must sign; if one co-lessee will not sign there is nothing to file. Each lessee also swears an affidavit on stamp paper: ask the vendor at 30 Bays Building for the current denomination.

It is a 50-day service (40 where a public notice is needed), starting only from a complete application. The transfer fee is not published, so file and pay against the office’s demand. Registration now triggers mutation within hours, so the pack must be complete.

What mistakes make an NOC useless?

  • Signing before you know what the office needs.
  • Letting one of two joint owners sign for both.
  • Writing an open-ended consent instead of the exact request and its limits.
  • Filing an incomplete pack at the Estate Office. There is no later filing to fix it.

Questions people ask

Does an NOC need stamp paper?

A landlord’s NOC for address proof or a utility connection carries no stamp duty, because it is a consent letter and not an instrument creating a right. A GST or company registration NOC is at most a small fixed sum, and a co-owner consent falls under the residuary article, a fixed sum rather than a percentage; confirm the Punjab or Chandigarh figure with the Sub-Registrar or an e-stamp vendor. The Estate Office application is on plain paper.

Does an NOC have to be notarised?

Not by law for a landlord’s NOC, though some authorities ask for the signature to be notarised. No statute requires it for a GST NOC either, but many desks reject a plain-paper one, so notarising is cheap insurance. A co-owner consent does not need it by law, but Sub-Registrars, advocates and banks routinely want it.

Can one co-owner sign an NOC for the others?

No. Every co-owner must sign. An NOC signed by one of two joint owners is routinely rejected at the GST desk, and nothing in a co-owner consent binds a person who has not signed.

Does a landlord’s NOC prove my tenancy?

No. An NOC for address proof confirms that you live at the premises and consents to its use as address proof, but it is not a tenancy agreement and creates or extends no tenancy right. A fresh tenancy needs a rent agreement.

Do I need Estate Office permission to sell a Chandigarh property?

For a Chandigarh leasehold or concessionally allotted site, yes: the application is filed at the Estate Office before the sale, gift or exchange, and the Sub-Registrar will not register the transfer deed without the NOC. A non-concessional freehold site and a Chandigarh Housing Board flat are not covered by that application.
