Stamp duty
Once countersigned, a commission agreement — Article 5, Schedule I-A, Stamp Act 1899 (PB/CH), a small fixed sum.
Registration
Not registrable: s.17, Registration Act, 1908 needs a Rs 100+ property interest created; this creates none.
Witnesses
Not required — the dated signatures are what matter, since the date of each agent's authority decides which of two competing agents introduced a buyer first.

When you need it

Happy for several dealers to sell to whoever comes first? Open listings cause the most commission disputes. This settles it: not exclusive; commission only to the effective cause of sale (dated introduction); nothing on a self-found buyer; withdrawable anytime.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Once countersigned, a commission agreement — Article 5, Schedule I-A, Stamp Act 1899 (PB/CH), a small fixed sum. Stamp before the agent countersigns (s.17).

Registration

Not registrable: s.17, Registration Act, 1908 needs a Rs 100+ property interest created; this creates none. Optional under s.18, pointless.

Notarisation

Not required — signed by both sides; adds nothing to an authority either side can end at any time.

Witnesses

Not required — the dated signatures are what matter, since the date of each agent's authority decides which of two competing agents introduced a buyer first.

From: Gurpreet Singh Sandhu, son of Harbhajan Singh Sandhu

1. Authority to market

1.1 I own the property at House No. 1147, Sector 70, SAS Nagar (Mohali), Punjab 160071, in Punjab: A two-storey house on a plot of 250 square yards, with a covered car porch ("the Property").

1.2 I authorise you to market the Property for sale at ₹85,00,000 (Rupees Eighty Five Lakh only) and to introduce prospective buyers to me, until 2 April 2026.

2. This listing is not exclusive

2.1 I may give the same authority to other agents, and I may sell the Property to a buyer I find myself without owing you anything.

2.2 You must not describe yourself, in any advertisement, signboard or conversation, as my sole or exclusive agent.

3. When commission is payable

3.1 Commission of 1 per cent of the sale price is payable to you only if you are the effective cause of the sale, and it is earned on the signing of an agreement to sell with a buyer the agent introduced.

3.2 You are the effective cause of the sale only if you first introduced the buyer to the Property, and that introduction led to the sale without the buyer being lost and then found again through someone else.

3.3 If two agents claim the same buyer, the agent who first introduced the buyer to the Property, as shown by a dated viewing record or a dated written introduction sent to me, is the effective cause. Only one commission is payable on the sale.

3.4 No commission is payable to you on a sale to a buyer I found myself, or to a buyer another agent introduced to me first.

3.5 Goods and services tax is payable on the commission in addition to it, and you will issue a tax invoice for it.

4. What you may and may not do

4.1 You may show the Property at times I agree. You will keep a dated record of every person you show it to, and send me that person's name before or at the viewing.

4.2 You have no authority to sign anything for me, to accept money on my behalf, or to agree a price.

4.3 Where the Property is an apartment, plot or building in a project registered with a Real Estate Regulatory Authority, you may deal in it only if you are registered as a real estate agent; you have told me your registration number is PBRERA-SAS80-REA0123.

5. Withdrawing this authority

5.1 I may withdraw this authority at any time by email or letter to you. It ends in any case on 2 April 2026 unless I renew it in writing.
