For a buyer whose Punjab project promoter hasn't delivered — late possession, a changed plan, shrunk area, an unregistered agreement, no conveyance deed, or a refused refund. Section 31, RERA Act lets any aggrieved person complain; rule 36(1) prescribes Form M at Rs 1,000.

THREE FORMS, printed only as needed: a relief against the promoter prints Form M plus its affidavit; a compensation sum ALSO prints Form N (to the Adjudicating Officer); an already-passed order's particulars print Form L alone (the Tribunal appeal) — each Rs 1,000, and appealing means leaving the relief field blank. Check registration on rera.punjab.gov.in first (project numbers like PBRERA-SAS81-PR0389) — but registration isn't jurisdictional: s.3 bars advertising/booking in an unregistered project, itself a ground of complaint, as is a lapsed (s.5(3)) or revoked (s.7) one. Development-authority projects (GMADA/GLADA) are complained of here too — PAPRA excludes authorities from ITSELF (s.44) but not from the 2016 Act. For a private colonizer, TWO statutes apply: ss.88-89, RERA make it additional to PAPRA, so PAPRA's stricter 25%/section-7-registration caps bind over RERA's 10%. PAPRA s.15/16 governs the conveyance deed (three months of possession, unilateral registration on default, penalty up to Rs 5,000/unit plus Rs 100/day). THE MONEY: s.18 lets a delayed buyer withdraw with interest, or stay and claim delay-interest (SBI MCLR plus 2%, rule 16, running both ways); rule 17 requires a refund within ninety days; s.63 penalises disobedience up to 5% of project cost per day. THE SPLIT: the Authority directs/refunds/orders interest — NOT compensation, which needs Form N to the Adjudicating Officer (s.71, rule 37(1)), broken down per s.72's loss-versus-gain test. APPEALING: s.44(1)-(2) gives 60 days to the Tribunal via Form L (rule 26), a paginated stitched paper book; s.58 gives a further 60-day High Court appeal. WHERE: First Floor, Block-B, Plot 3, Sector 18-A, Chandigarh (0172-5139800-29) or Ground Floor, Punjab Mandi Bhawan, S.A.S. Nagar — forty minutes apart, call ahead. File online with a 'Complainant' login. NOT FOR: the promoter (needs the s.43(5) deposit and a different memorandum); a private resale; a pure estate-administration grievance (the Estate Officer's own ladder); a Chandigarh project (this pack is Punjab-specific, even though the Authority sits in Chandigarh); a standalone compensation claim; a second bite on decided facts (appeal instead); a matter alive elsewhere (the sworn no-parallel-proceeding declarations make that false); or without first reading the promoter's own portal filings.

None of the three forms attracts duty — not instruments (s.2(14)); plain paper. THE RULES FEE: Rs 1,000 each for Form M (rule 36(1)), Form N (rule 37(1), same payee, the Authority), and Form L (rule 26(1), but favouring the TRIBUNAL, a different payee) — Rs 3,000 total for all three, one draft can't cover two. Cleaner: pay online at rera.punjab.gov.in — the pack prints only the payment particulars matching what you actually did, since an invented DD number in a sworn document is a false particular. Stamp applies to ONE document: the supporting affidavit (prints only with Form M) — Article 4, Schedule I-A; GMADA/GLADA panels specify Rs 25 non-judicial paper, the working figure. Buy as a Punjab e-stamp in the DEPONENT'S OWN NAME. Trap: the Authority/Tribunal sit in Chandigarh though the proceeding is Punjab's — ask if a Chandigarh e-stamp is wanted where the deponent swears there. Behind many complaints: the eventual conveyance deed's 5%+1%+1% duty stack (as elsewhere in Punjab), no gender concession.

रजिस्ट्री

Nothing in this pack is registrable — none of the three forms or the affidavit creates a property interest (s.17). What IS compulsorily registrable — often the complaint's heart — is the AGREEMENT you're suing on: s.13(1), RERA (10% cap) and PAPRA ss.6-7 (25% cap, stricter, binding) both require one; an unregistered agreement after payment is itself a contravention, and the relief options include a direction to register. The model form depends on the project's RERA registration date (2017 Rules to 8.10.2020; Form Q 2020 from then; Form Q 2022 from 26.8.2022). The conveyance deed: due within three months of the occupation certificate (s.17, RERA) or possession (s.15, PAPRA); on default, s.16 forces unilateral registration, penalty up to Rs 5,000/unit plus Rs 100/day. Check the PROJECT's own s.3 registration status on rera.punjab.gov.in — live, lapsed (s.5(3)) or revoked (s.7); an unregistered project has an ADDITIONAL contravention to answer for, not immunity.

नोटरी

The three forms are verified, not sworn — the Gazette-prescribed verification (8.6.2017), signed personally by every complainant/appellant, no notary involved. The AFFIDAVIT needs one — prints only with Form M. Deponent appears in person with photo ID, signs before the notary, who enters a serial number on the register — get it written on the affidavit. Read paragraph 6 before swearing — the no-parallel-proceeding declaration; a live consumer complaint or suit on the same facts makes it false. Many Punjab allottees live abroad — a foreign-sworn affidavit is refused more than anything else: use an Indian consular officer, or a local notary plus apostille. An attorney swearing for an absent allottee can only swear to their own knowledge — a real weakness on booking-stage facts.

गवाह

No attesting witnesses on any form or the affidavit — the verification plus sworn affidavit are what the Registry checks. Every joint allottee signs every form (a second signature block prints automatically) and swears a separate affidavit. Sign every page, paginate the whole file (rule 26(2)'s double-spacing/stitching applies in spirit to a complaint too). Where the complainant isn't a natural person: AUTHORITY, not witnesses — board resolution, partnership authority, kartaship evidence, or a managing committee's resolution for an allottees' association. A representative under s.56 needs their authorisation and written consent in original (rule 26(5)).

FILING PACK — PROCEEDINGS BEFORE THE REAL ESTATE REGULATORY AUTHORITY, PUNJAB
Under the Real Estate (Regulation and Development) Act, 2016 and the Punjab State Real Estate (Regulation and Development) Rules, 2017

WHAT THIS FILE CONTAINS. Only the documents your answers call for are printed below, and each of them carries its own separate fee of one thousand rupees and is filed in its own place.
— FORM 'M', the complaint to the Authority under section 31 of the Act read with sub-rule (1) of rule 36 of the Punjab Rules, together with the affidavit that supports it. It is printed because a relief against the promoter has been asked for.
— FORM 'N', the separate application to the Adjudicating Officer under sub-rule (1) of rule 37 of the Punjab Rules. It is printed because a sum of compensation has been claimed. The Authority gives directions and orders refund and interest; it does not adjudge compensation, which is for the Adjudicating Officer appointed under section 71 of the Act.
— FORM 'L', the appeal to the Real Estate Appellate Tribunal, Punjab under section 44 of the Act read with rule 26 of the Punjab Rules. It is printed because an order already passed is being challenged.

A fresh complaint and an appeal against an order already passed are different proceedings, and this pack is not meant to produce both in one file. If an order has gone against you, give the particulars of that order and leave the relief against the promoter blank, so that the appeal alone prints. If you are making a fresh complaint, choose the relief and leave the order particulars blank.
