Stamp duty

No ad valorem duty on the complaint itself. Two small charges can apply: a court-fee stamp under the state Court-fees Act (low, office-set); and an affidavit filed with it IS chargeable (Maharashtra: Rs 100, Art.4, Sch.I, Maharashtra Stamp Act 1958; other states, their own amount). Under-stamped, it's returned and you lose the filing date.

Registration

None — not within s.17, Registration Act 1908; no sub-registrar involved. File at the Registrar's counter for an inward number/date on your copy; by post, use A.D. or speed post with proof. Email-only complaints often disappear — follow with a hard copy, quote the inward number.

Notarisation

The complaint needs no notary — your signature under the verification clause suffices. The affidavit many offices want alongside it does: swear before a notary/oath commissioner on prescribed stamped paper, noting the register entry number. Practice varies by office — ask before travelling.

Witnesses

None — a pleading, not an executed instrument. What's needed is proof: postal receipts/acknowledgements for every letter sent, replies, minutes, notices, the disputed demand — annexed and schedule-listed. An advocate filing for you needs a vakalatnama; anyone else, a signed authority letter.

Subject: Complaint against the Managing Committee of Sunder Nagar Co-operative Housing Society Limited (Registration No. BOM/WK/HSG/(TC)/12345/2003-04), concerning the refusal or unreasonable delay of the Managing Committee in transferring the flat, the shares and the membership.

Sir / Madam,

1. THE COMPLAINANT

1.1 I, Meera Rajan Deshpande, aged about 54 years, residing at X, am a member on the register of the Society, in respect of Flat No. B-704, Sunder Nagar, B Wing in the building of Sunder Nagar Co-operative Housing Society Limited (hereinafter "the Society"), and I make this complaint in that capacity. I reside in the said flat. This complaint is made jointly by me and by X, the joint holder with me in respect of the said flat, who signs it below.

1.2 My status in relation to the Society is evidenced by the records of the Society. My membership number is X. The shares relating to the said flat are covered by Share Certificate No. 118, Distinctive Nos. 586 to 590. I was admitted to membership of the Society on 2 April 2026. The shares and the interest in the capital and property of the Society in respect of the said flat stood in the name of Rajan Vishnu Deshpande, a member of the Society. The said member died on 3 April 2026. My entitlement in respect of the said shares and interest arises under the nomination made by the deceased member in Form No. 14 and recorded by the Society on 8 September 2019, a copy of which is annexed. I am competent to make this complaint in the capacity stated above.

2. THE SOCIETY AND ITS MANAGING COMMITTEE

2.1 The Society is registered under the Maharashtra Co-operative Societies Act, 1960 bearing Registration No. BOM/WK/HSG/(TC)/12345/2003-04, registered on 1 April 2026, and has its registered office at X. The Society is subject to the supervisory jurisdiction of your office.

2.2 The affairs of the Society are managed by its Managing Committee, which holds office as a body of trustees of the funds and records of the Society and is bound to act within the four corners of the Maharashtra Co-operative Societies Act, 1960, the rules made under it, and the registered bye-laws of the Society. Any act of the Committee that is not traceable to a power conferred by the statute, the rules or the bye-laws is without authority.

2.3 The members of the Managing Committee against whose acts and omissions this complaint is directed are:
