When you need it

Use this when a building departs from its sanctioned plan and you want the authority to rule if it can be compounded or must be removed. Chandigarh's rules distinguish sanctionable, compoundable and non-compoundable departures — the last removed before occupation; Punjab has its own rules.

A fee alone doesn't entitle you to keep a non-compoundable deviation.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty: creates no right in property, not an instrument under section 2(14), Indian Stamp Act, 1899. The compounding fee is the authority's charge, not duty, and doesn't make a non-compoundable deviation lawful.

Registration

Registration is not required.

Notarisation

Not required, unless the authority asks for an affidavit.

Witnesses

Not required. The owner's and the professional's signatures suffice.
