When you need it

A leasehold/allotment interest changed — by assignment, approved transfer, inheritance or similar — so the record must show the current holder, lease, transfer basis, term and identifiers. Not a freehold conversion absent a separate order; preserves covenants and the lessor's superior title.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty: a s.34 mutation report transfers nothing (outside Schedule I-A); duty was due on the source instrument. No court fee. Cost is the Rs 600 mutation fee (Punjab Revenue Dept, 6 Sep 2026), recovered under s.38(2) at attestation from the person favoured; late reporting (past 3 months) risks a s.39 fine up to 5x — Rs 3,000.

Registration

Not registrable — outside s.17, Registration Act, 1908. The Patwari logs it in the register of mutations, the Kanungo validates it, returning an intkal number and order. An unregistered instrument needing registration can't found a mutation.

Notarisation

Not required unless the authority asks for an affidavit, declaration or attested copy.

Witnesses

Not ordinarily required; the authority may call for witnesses or identifiers at attestation or hearing.

LEGAL BASIS

In Punjab this application is the report of a change in rights under section 34 of the Punjab Land Revenue Act, 1887. It is addressed to the Circle Revenue Officer through the Halqa Patwari of the revenue estate, and can be handed to the Patwari or lodged at the Fard Kendra of the tehsil or sub-tehsil; the Halqa Patwari enters it in the register of mutations, the Field Kanungo validates the entry, and the Circle Revenue Officer, a Naib Tehsildar or Tehsildar, attests, sanctions or rejects it. A mutation records a change of rights; it does not create title. An entry in the record of rights is presumed true only until the contrary is proved (section 44 of the Act), and section 45 sends anyone who disputes it to a civil suit for a declaration. In Chandigarh only the Union Territory's revenue villages carry a jamabandi; there the Patwari holds the record of rights and the Tehsildar or Naib Tehsildar of the Union Territory attests the mutation. A sector property held from the Estate Office has no jamabandi and is not mutated this way: the Estate Office's own transfer procedure applies. A leasehold site of the Estate Office also needs the Estate Office's no-objection certificate before the transfer and payment of one-third of the unearned increase under rule 7(ii) of the Chandigarh Estate Rules, 2007, and a site allotted by a development authority, such as GMADA, is re-transferred in the authority's own records on its own application.
