Mutual Divorce Settlement Terms

ਮੁਫ਼ਤ
ਸਟਾਂਪ ਡਿਊਟੀ
A settlement of this kind — recording alimony, stridhan and custody terms and, at most, an agreement to divide property by later, separate instruments — is chargeable as an Agreement under Article 5, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, and under Article 5, Schedule I to that Act as extended to the Union Territory of Chandigarh.
ਰਜਿਸਟਰੀ
Not compulsorily registrable under section 17 of the Registration Act, 1908 as drafted here, because it does not itself create, assign or extinguish a right, title or interest of value in immovable property — clause 4 requires any such transfer to be made by a separate instrument.
ਗਵਾਹ
The Indian Contract Act, 1872 does not require attesting witnesses for an agreement of this kind, but Family Court practice, and prudence given what is at stake, calls for two witnesses who are not related to either Party.

ਕਦੋਂ ਲੋੜ ਪੈਂਦੀ ਹੈ

Both spouses have agreed the marriage should end by mutual consent and need to put every term of that agreement into one signed document — permanent alimony (a lump sum, periodic payments, or none), return of stridhan and gifts, custody and maintenance arrangements for any child of the marriage, division of jointly held property and bank balances, withdrawal of pending proceedings between them, and a mutual undertaking not to raise further claims once the terms are honoured. A Family Court very commonly expects a written settlement of exactly this kind at the first motion, and the eventual decree is frequently passed "in terms of the settlement" placed on its record.

This is the private settlement, not the court filing. To actually move the court, use the Mutual Divorce Petition (Section 13-B, First Motion) in this library and annex this Settlement to it, or produce it when the Family Court asks how the parties have resolved alimony, custody and property. Not for a contested divorce, where these terms are not yet agreed — a fault-ground petition under section 13 of the Hindu Marriage Act, 1955 is a different matter this template does not address. This Settlement records the parties' commercial and parenting terms and is not itself tied to one Act's procedural mechanics; check which mutual-consent provision — section 13-B of the Hindu Marriage Act, 1955 or section 28 of the Special Marriage Act, 1954 — governs the petition it will be annexed to.

Both schedules have been amended by the respective governments in recent years and neither publishes a single easily citable, dated rate for a general agreement; confirm the amount currently chargeable — and whether it differs for a memorandum produced before, or annexed to, a Family Court petition — with a stamp vendor, the Treasury, or the office of the Collector before this Settlement is executed, and buy non-judicial stamp paper of that value or e-stamp it through the Stock Holding Corporation of India Limited (SHCIL, shcilestamp.com), the authorised e-stamping agency for both Punjab and Chandigarh. If this Settlement is instead placed directly on the Family Court's record as part of the petition, ask the filing counter whether court-fee stamping under the Court Fees Act, 1870 as locally applicable is wanted in place of, or in addition to, Article 5 stamping.

ਰਜਿਸਟਰੀ

Not compulsorily registrable under section 17 of the Registration Act, 1908 as drafted here, because it does not itself create, assign or extinguish a right, title or interest of value in immovable property — clause 4 requires any such transfer to be made by a separate instrument. Where the parties do want this Settlement itself registered for the extra evidentiary weight that gives it, it may be presented as a Book 4 miscellaneous document at the office of the Sub-Registrar of the tehsil in Punjab, or the Sub-Registrar, Union Territory of Chandigarh at 30 Bays Building, on payment of the registration fee prescribed for that book. Where this Settlement is instead annexed to and taken on the Family Court's record with the mutual-consent petition, the court file becomes its own record and separate registration is not usually necessary.

ਨੋਟਰੀ

Not compulsory, but both spouses should sign in the presence of, and have their signatures attested by, a Notary Public or an Oath Commissioner, particularly where the Settlement will be relied on later or annexed to the petition — a Family Court commonly also expects each spouse to swear a short supporting affidavit confirming this Settlement was entered into voluntarily, which is a separate document this template does not draft.

ਗਵਾਹ

The Indian Contract Act, 1872 does not require attesting witnesses for an agreement of this kind, but Family Court practice, and prudence given what is at stake, calls for two witnesses who are not related to either Party. Both Parties and the witnesses should sign the same copy at the same sitting where practicable.

BETWEEN

AND

Neha Chopra, of House No. 22, Model Town, Ludhiana 141002 (the "Wife").

The Husband and the Wife are each a "Party" and together the "Parties".

RECITALS

A. The Parties were married to each other on 1 April 2026 at Ludhiana.

B. The Parties have been living separately since 2 April 2026 and have been unable to live together as husband and wife.

D. Before so moving, the Parties have negotiated and now record, in this Settlement, the terms on which their marriage is to be dissolved, including the custody and maintenance of any child of the marriage, permanent alimony, stridhan, and the division of property between them.

E. Each Party has entered into this Settlement voluntarily, of their own free will, without coercion, undue influence or misrepresentation by the other, after having had the opportunity to take independent legal advice.
