When you need it

A bank mandate: the account holder authorises one Operator to pay in, draw out, sign cheques and transfer, within limits, for a purpose and period. Uses: an elderly parent, a trip abroad, hospitalisation, or NRO operation.

Doesn't replace the bank's own form/KYC. Clause 11: you indemnify the bank for acts on the Operator's instructions. Don't use it for ownership (use a joint account, nomination or will), property/tax/court matters, or once capacity is lost. A minor can't hold this.

What follows is the position for this kind of document. The amount is set by the state the property is in and it changes, so the figure for your own state is worth confirming at the sub-registrar’s office before you pay anything.

Stamp duty

Article 48 (Article 41, Karnataka) — banking-only, the fixed low-value entry: commonly Rs 100-500 by state and appointee count. Pay via stamp paper or e-stamp — verify the current Schedule. A sale-of-property power is charged as a conveyance elsewhere — this mandate isn't that. Abroad: stamp within three months of first arrival (s.18).

Registration

Not compulsorily registrable — s.17 doesn't catch it; optional under s.18. Only the bank's counter matters. Contrast: a sale-of-property power IS registered in several states (ss.32, 32A, 33 govern presentation, photos/fingerprints) — none applies here.

Notarisation

Not legally required, but banks want it notarised alongside KYC. A notarised power attracts the s.90, Bharatiya Sakshya Adhiniyam, 2023 presumption. Abroad: notarise plus apostille, then stamp within three months — skipping this gets an NRI mandate refused.

Witnesses

No statute requires witnesses. Sign before two — not the Operator, spouse, parent, child, or a beneficiary; record names, addresses, ID. If the Holder can't sign, the bank needs an attested thumb impression. Every joint holder signs; the Operator signs separately with specimen signatures.

AUTHORITY TO OPERATE A BANK ACCOUNT
(A limited banking mandate. Not a general power of attorney.)

Executed on 1 April 2026 at Chandigarh (Andhra Pradesh).

NOTE TO THE BANK AND TO BOTH SIGNATORIES
This authority records the terms agreed between the Account Holder and the Operator, and is given to the Bank in support of a mandate request. It does not replace the Bank's own mandate form, specimen-signature card or KYC formalities, and the Bank may require all of those before the Operator is allowed to operate the Account. This is not a joint account, not a nomination and not a transfer of the money in the Account. The Operator receives authority to act. The Operator receives no ownership of a single rupee.

  1. 1. THE PARTIES

1.1 Account Holder: Sunita Ramesh Deshpande, W/o Shri Ramesh Deshpande, aged 71 years, resident of X, holding Aadhaar no. XXXX XXXX 4417 (referred to below as "the Account Holder", "I" and "me").

1.2 Operator: Aditi Sunita Deshpande, D/o Shri Ramesh Deshpande, aged 38 years, resident of X, holding Aadhaar no. ABCDE1234F (referred to below as "the Operator").

1.3 Relationship of the Operator to the Account Holder: Spouse.

Email address for notices to the Operator: X.

  1. 2. THE ACCOUNT

2.1 Bank: State Bank of India ("the Bank").

2.2 Branch: Sector 22 Branch, SCO 1234, Chandigarh 160022 ("the Branch").

2.3 Account: the Savings Bank account bearing account no. 3012 4456 7789, IFSC SBIN0001234, held at the Branch ("the Account").

2.4 The Account is held jointly. The other holder or holders of the Account are Ramesh Vasant Deshpande. They join in this authority and sign it below to record their consent, and every reference below to my instructions is to be read as the instructions of all holders.

  1. 3. WHY I AM GIVING THIS AUTHORITY

3.1 My purpose is this: I am 71, recovering from a hip replacement and unable to travel to the branch. My daughter will pay my household bills, medical expenses and society maintenance from this account until I can attend the branch again.

3.2 The Operator must use the Account only for that purpose, and for nothing else.

  1. 4. WHAT THE OPERATOR MAY DO

4.1 Subject to clauses 5 and 6, I authorise the Operator to do the following on the Account, and nothing beyond it: pay in cash and cheques, withdraw cash by cheque or withdrawal slip, and obtain statements, passbook entries and cheque books.

4.2 Mode of operation: Singly. The Operator may sign and give instructions alone, without any second signature.

4.3 Every cheque, instruction, form or instrument that the Operator signs under this authority must be signed in a form that shows the Operator is signing for me and not personally, such as "Aditi Sunita Deshpande, authorised to operate account no. 3012 4456 7789 for Sunita Ramesh Deshpande", or in whatever form the Bank prescribes.
