When you need it

A limited POA letting an owner's chosen person let and run a property day to day — advertise, sign the letting agreement, collect rent/deposits, deal with the society, pay dues, arrange repairs, account for money. Standard for an owner abroad or elsewhere.

Deliberately narrow: bars sale/gift/exchange/mortgage; a POA conveys no title. Five form answers matter: longest agreement the attorney may sign; whether he may admit execution/present a registrable agreement; litigation scope; substitution rights; income-tax scope — registration matters most, since it decides how this Power itself must be authenticated. Not for: an attorney who sells/mortgages/gifts or grants redevelopment rights; a principal under 18; a company/LLP/trust/HUF owner (needs a resolution); or where a bank's own mandate suffices.

What follows is the position for this kind of document. The amount is set by the state the property is in and it changes, so the figure for your own state is worth confirming at the sub-registrar’s office before you pay anything.

Stamp duty

Article 48; letting/management only, no sale — the general 'any other case' entry, a modest fixed duty, not ad valorem; the family concession and conveyance-rate treatment attach only to a sale power. Duty follows the state of SIGNING: sign where the property lies and that's it; sign elsewhere, and pay that state's differential duty too when acted on where the property lies. Signed abroad: stamp within three months of receipt (s.18). The letting agreement itself carries separate duty.

Registration

Not compulsorily registrable itself — creates no interest, so s.17(1)(b) doesn't apply; it is not a power to sell or develop, so nothing else makes it registrable either. The real bite is s.33: if the Attorney is to admit execution or present a registrable letting agreement, the Power must satisfy s.33, turning on the PRINCIPAL's residence. Principal in India: s.33(1)(a) — authenticated by the Registrar/Sub-Registrar of the PRINCIPAL's OWN district, not the property's (a Ludhiana owner with a Mohali flat authenticates in Ludhiana); notarised alone doesn't qualify. Principal abroad: s.33(1)(c) — notary, court, judge, magistrate, or Indian Consul. Why it matters: leases over a year are compulsorily registrable (s.17(1)(d)), and in Punjab and Chandigarh a "licence" that is in substance a lease is treated as one — use the s.33 route matching your residence if the attorney will present documents.

Notarisation

Signed in India: a Notary under the Notaries Act 1952, photo ID both parties, register entry — enough where the Attorney only signs agreements and deals with society/banks/utilities, not enough for presentation. Where the Principal is in India and presentation is needed, s.33(1)(a) requires Registrar/Sub-Registrar authentication of the PRINCIPAL's own district; notarised alone doesn't qualify. Signed abroad: notarise there plus apostille or Embassy/Consulate attestation; s.33(1)(c) recognises a notary, court, judge, magistrate or Consul for a principal abroad, though sub-registrars often still prefer consular attestation. Stamp in India within three months.

Witnesses

No statute requires attestation (unlike a will, s.63, or mortgage, s.59) but two adult witnesses are universal and expected by banks/societies/sub-registrars — full names, addresses, IDs, nobody who is the attorney, a tenant, or otherwise benefiting. On registration, s.32A requires the presenter's photo and fingerprints. Have the principal attest the attorney's specimen signature.

5. Why I am granting this Power

6. Nature and limits of this Power — read this first

6.1 This is a power of agency only. It does not sell, transfer, gift, exchange, mortgage, charge, release or otherwise dispose of the Property or any part of it, and it creates no right, title or interest in the Property in favour of the Attorney.

6.2 A power of attorney is not a conveyance. In Suraj Lamp & Industries (P) Ltd. v. State of Haryana, (2012) 1 SCC 656 the Supreme Court held that a transaction carried out by a power of attorney, an agreement to sell and a will does not convey title to immovable property. No person may treat this Power, alone or with any other writing, as evidence that the Property or any interest in it has been transferred to the Attorney or to anyone else.

6.3 The Attorney must not sell, agree to sell, gift, exchange, mortgage, charge, create any lien over, surrender, relinquish, partition or part with ownership of the Property; must not accept earnest money, advance or sale consideration for it; must not offer it as security for any borrowing by anyone; and must not create any interest in it other than a letting expressly permitted by this Power.
