When you need it

For a co-allottee's written consent to a transfer, exit, substitution or restructure — proof the promoter/incoming transferee aren't bypassing them. States the current share, the exact change, any consideration claim, lender condition, and waiver scope.

Alone, it doesn't complete the transfer — assignment, substitution and lender release still must happen.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A pure consent transfers nothing — falls to residuary Article 5, Sch.I-A (fixed sum; ask the Sub-Registrar). Risk: wording that releases/relinquishes a share, or takes a price share for consenting, lets the Sub-Registrar recharacterise it as a Release under Article 55 (ad valorem) — get it adjudicated first (s.31). Under-stamped: impounded, inadmissible until duty+penalty paid.

Registration

Not required for the consent alone — the operative document may need its own registration.

Notarisation

Not required; doesn't replace registration needed for the operative transfer.

Witnesses

Not ordinarily required, though promoter/lender forms may prescribe their own attestation.

CONSENT

I consent to: Transfer of the entire allotment to the named incoming transferee.

Consideration position: Consenting co-allottee makes no separate claim to the transfer consideration except as stated below. My agreed consideration share: ₹5,00,000 (Rupees Five Lakh only).

Lender condition: Consent is subject to any required lender NOC or release. Promoter condition: Consent is subject to promoter transfer or substitution approval.

Waiver scope: Consenting co-allottee will not object to the specific transfer once stated conditions are completed.

This consent supports only the stated transfer or reconstitution. It is not itself the assignment, promoter substitution or final conveyance. Where the whole allotment is to pass, my own share passes only if I also sign the assignment or substitution documents as a transferor; this consent does not transfer it.
