When you need it

The buyer's sworn affidavit that goes with that application — on stamp paper and notarised, filed with the Section 118 Permission Application (Non-Agriculturist Land Purchase) in this library. You are the non-agriculturist buyer applying for permission under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972, and the Collector needs your own sworn word on whether you have already acquired land in Himachal Pradesh under section 118 before — because permission is capped, and a buyer who already holds land taken under an earlier section 118 order may find that cap works against a further purchase.

This affidavit either says you have not, or discloses what you have, so the Collector can weigh the current application correctly. Use it beside the Section 118 Permission Application and the Transferor's own affidavit. Where you are buying jointly with someone else, each buyer swears this affidavit separately.

What follows is written for Himachal Pradesh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Sworn on plain paper or on non-judicial stamp paper of nominal value, as the Collector's office in the district concerned requires for an affidavit filed with a section 118 application — confirm the current denomination before swearing it.

Registration

Not compulsorily registrable. It is filed as an annexure to the section 118 application before the Collector (Deputy Commissioner) of the district in which the land lies, and does not itself need to be presented for registration under the Registration Act, 1908.

Notarisation

Sworn before a Notary Public, an Oath Commissioner, or an Executive Magistrate having jurisdiction where the deponent resides. Carry original identity proof.

Witnesses

No attesting witnesses beyond the oath are customary, but confirm the requirement of the particular Collector's office before relying on that.
