Stamp duty
Sworn on plain paper or on non-judicial stamp paper of nominal value, as the Collector's office in the district concerned requires for an affidavit filed with a section 118 application — confirm the current denomination and whether e-stamping through the State's authorised vendor is expected, since this could not be confirmed with confidence here.
Registration
Not compulsorily registrable.
Witnesses
No attesting witnesses beyond the oath are customary for an affidavit of this kind, but confirm the requirement of the particular Collector's office before relying on that — some district offices ask for a prescribed proforma or identifying witness of their own, and this template does not reproduce any single district's local format.

When you need it

The seller's sworn affidavit that goes with that application — on stamp paper and notarised, filed with the Section 118 Permission Application (Non-Agriculturist Land Purchase) in this library. You are selling land in Himachal Pradesh to a buyer who is not an agriculturist, and the sale needs the Collector's permission under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972.

This is the Transferor's own sworn affidavit, filed with that application, satisfying the Collector that the sale will not leave you landless or without the means to support yourself and your family. This is one of three sworn papers a section 118 file commonly carries, alongside the application itself and, where the land is jointly held, the other co-sharers' no-objection affidavit. Use it beside the Section 118 Permission Application. Not for: a sale between two agriculturists, which needs no section 118 permission and no landless declaration; or a transferor who is a minor, of unsound mind, or whose share is under the Court of Wards — such a transferor's affidavit is sworn by a guardian or manager, which this template does not attempt to cover.

What follows is written for Himachal Pradesh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

It is filed as an annexure to the section 118 application before the Collector (Deputy Commissioner) of the district in which the land lies, and is not presented for registration under the Registration Act, 1908 in its own right.

Notarisation

Sworn before a Notary Public, an Oath Commissioner, or an Executive Magistrate having jurisdiction where the deponent resides or where the land lies. Carry original identity proof; the attesting officer will not swear an affidavit from someone they cannot identify.

Witnesses

No attesting witnesses beyond the oath are customary for an affidavit of this kind, but confirm the requirement of the particular Collector's office before relying on that — some district offices ask for a prescribed proforma or identifying witness of their own, and this template does not reproduce any single district's local format.
