कब ज़रूरत पड़ती है

The letter a buyer signs before parting with money — engaging an advocate to investigate title over at least 30 years and certify it in writing, matching the standard section 3(2)(a)/18(1)(a), Punjab Apartment and Property Regulation Act, 1995 sets for a promoter (advocate of 7+ years). For a registered real-estate project, the promoter must publish its own encumbrance certificate/title report from a 10-year advocate (rules 3(1)(e)/15(1), Punjab RERA Rules, 2017) — ask for it and have your own advocate review it.

Two completely different tracks, in two attached schedules. PUNJAB (Schedule A): the jamabandi is not a title register — an entry is presumed true only until disproved (s.44, PLRA), so a real search runs the fard through every quinquennium, the mutation chain behind each change, an index/NEC search at the Sub-Registrar, a litigation search, a shamlat check, and a pre-emption check. Much Punjab property (abadi/municipal/urbanised) has NO revenue record at all — title runs on registered deeds and the municipal record instead. PRE-EMPTION IS THE RISK THAT SURVIVES COMPLETION: under the Punjab Pre-emption Act, 1913, a co-sharer (on a share sale) or a sitting tenant can still sue to take the land within ONE YEAR of mutation or possession, whichever is earlier — identify every co-sharer and get a relinquishment, or have them attest the deed, before completion. CHANDIGARH (Schedule B): no jamabandi — the Estate Officer's allotment file is title. Check tenure, ground rent, NOC/unearned-increase, occupation certificate, misuse, and the 2023 transfer freeze (still unresolved) on residential property with unrelated co-owners. Since 2025, auto-mutation means the affidavit pack must be complete and correct at the Sub-Registrar's counter on registration day — no later fix. Not: an agreement to sell (creates no seller obligation); an NEC application; the seller's Estate Office NOC application; a valuation, tax advice, or litigation instructions; or usable outside Punjab/Chandigarh. A bank panel advocate's search protects the bank, not you — instruct your own as well. The engagement terms matter as much as the checklists: either side can end it on notice (fees only for work done); the advocate must hand over certified copies AND every application's acknowledgment number within 15 days; and the advocate must step back if a conflict emerges. A checklist only surfaces gaps — read what the advocate says could NOT be obtained before you read what was.

The letter, the advocate's acknowledgment, and the certificate of title carry no stamp duty — none is an instrument under section 2(14), Stamp Act, 1899; plain paper. Any affidavit sworn alongside (one-and-same-person, indemnity, a Chandigarh affidavit-cum-indemnity bond) is a separate, separately-stamped instrument — Punjab has no sourced affidavit denomination (ask the vendor); Chandigarh e-stamps through SHCIL's forms. What the TRANSACTION itself will cost, Punjab: a sale/gift draws 5% duty (Entry 23, Schedule I-A) PLUS three add-ons that survive any duty remission — 1% Social Infrastructure Cess, 1% PIDB fee, 0.25% Special Infrastructure Development Fee (together, budget 7.25%) — plus 1% registration fee (capped Rs 2,00,000), slab facilitation charges, and Rs 200 pasting. A FEMALE buyer gets a 2-percentage-point reduction on a conveyance only (not gift/lease/mortgage/POA) under a 2010 notification; a transfer to blood relations (children/grandchildren/siblings) is fully duty-exempt. Other instrument types (lease-rights transfer, GPA, mortgage, partition) carry their own separate Punjab rates — confirm at the Sub-Registrar. Chandigarh: a sale/gift/conveyance is 5% of value/consideration (verified live on the District Collector's own calculator — the 6% widely quoted online is wrong), registration 1% capped Rs 10,000, Rs 20 pasting; no gender concession exists. Lease-rights transfers, GPA, mortgages and partitions each carry their own separate Chandigarh rates. Duty in both places runs on the higher of price or the notified collector/circle rate — get the current schedule before budgeting, and note Rule 15, Chandigarh Estate Rules, 2007 puts the whole cost on the buyer.

रजिस्ट्री

The letter itself isn't registrable — section 17, Registration Act, 1908 doesn't reach an instruction to a professional. Sign two originals; email a scanned copy the same day to fix the instruction date. What IS registrable in the chain being investigated: a sale deed of property worth Rs 100+ (s.17(1)(b)) and a lease over one year (s.17(1)(d)) — unregistered, either is inadmissible to prove the transaction (s.49). Punjab-specific: section 7, Punjab Apartment and Property Regulation Act, 1995 requires a promoter's plot/apartment agreement to be registered too — an unregistered one in the chain is a defect to report, though it stays usable for specific performance (s.8). Punjab: registration triggers the Parcha Yadasht that starts mutation; report the acquisition within 3 months or risk a fine up to 5x the mutation fee (s.39, PLRA). CRITICALLY, the one-year pre-emption window (s.30, Punjab Pre-emption Act, 1913) starts from the EARLIER of mutation attestation or taking possession — until one happens, the clock hasn't even started, so don't let mutation drift after completion. Chandigarh: registration at the Sub-Registrar auto-triggers Estate Office mutation digitally since 2025, with no later filing to fix a defective affidavit pack — it must be right on the day. Where residential property falls outside the four categories the Estate Officer's 2023 notice still permits, change of ownership may be stopped regardless of a clean search.

नोटरी

Not required — the letter, the advocate's acknowledgment, and the certificate of title are unsworn professional documents. Where an attorney signs for the buyer, produce the power of attorney in original (registered, for buying property); anything executed abroad for a Chandigarh transaction needs embossing by the Finance Department first. The affidavits that travel WITH the purchase — a one-and-same-person affidavit, a seller's indemnity, a no-litigation declaration, or Chandigarh's affidavit-cum-indemnity bond — are separate sworn instruments, each on its own stamp paper, each deponent swearing separately (two sellers need two affidavits). Punjab: before a Notary or Oath Commissioner. Chandigarh: a notarised affidavit is accepted in place of Executive Magistrate attestation. A company/trust/firm buyer's authority document is typically notarised too. None of this makes a shown document genuine — only the certified copies and dated portal prints the advocate obtains from the record office do that.

गवाह

None on the letter itself — nobody is executing a transfer. The deed the search protects is different. Punjab: two witnesses appear in person before the Sub-Registrar (ss.32/34, Registration Act, 1908); neither party can witness for the other. Distinctively, a co-sharer who holds a right of pre-emption and ATTESTS the sale deed as a witness is held to have WAIVED that right — if a co-sharer could pre-empt, get them to attest rather than merely consent; it costs nothing and closes a year-long risk. Chandigarh: two witnesses, the FIRST qualifying under paragraph 127, Punjab Registration Manual (a Lambardar/Sarpanch/Panch in a village area, or a councillor, gazetted officer or advocate), both known to each other and the first known to the Sub-Registrar — bringing two unqualified neighbours means no valid first witness at all. Using your own advocate as that witness is convenient but weakens their independence if title later fails; consider a different advocate for it. Purchase affidavits are sworn, not witnessed — a notarial register entry is the record, not a witness line.

SUBJECT: Instructions to investigate the title to agricultural land situated at House No. 1234, Sector 21-B, Chandigarh 160022, in the State of Punjab, offered for sale by Sh. Ram Lal Sharma and Smt. Shanti Devi Sharma, to examine the transactions concerning it from 2 April 2026 down to the date of your report and in any event over not less than the thirty years immediately preceding it, and to furnish a written certificate of title

Dear Sir / Madam,

PART I — THE CLIENT, THE PROPERTY AND THE SELLER

1. The Client. I, Harpreet Kaur Gill, son of Sh. Amarjit Singh Gill, resident of House No. 47, Model Town Extension, Ludhiana 141002, telephone +91 XXXXX XXXXX, e-mail harpreet.gill@example.com, and Manpreet Singh Gill, son of Sh. Amarjit Singh Gill, resident of House No. 47, Model Town Extension, Ludhiana 141002 (together the Client, whether one person or more), am the intending purchaser of the property described in Schedule C, and I instruct you on the terms set out below. Where more than one of us is named above, you are engaged by each of us and you owe your duty to each of us.

2. The Property. agricultural land situated at House No. 1234, Sector 21-B, Chandigarh 160022, in the State of Punjab, admeasuring 10 Marla (250 square yards) (the Property), described more fully in Schedule C at the end of these instructions.

3. Revenue particulars, where the Property lies in the State of Punjab. The Property lies in the revenue estate of Village Dhandari Kalan, Tehsil Ludhiana (East), District Ludhiana. The Hadbast number of the revenue estate is 197. The Property is entered in the jamabandi at Khewat and Khatauni Khewat No. 412, Khatauni No. 561/2. The Khasra numbers comprised in the Property are Khasra Nos. 118//4 (8-0), 118//5/1 (3-12) and 118//6 (8-0), total measuring 19 kanals 12 marlas. Where the Property lies in the State of Punjab and any of these particulars is missing or is stated wrongly, you are to take the correct particulars from the fard and to tell me in your report what was corrected and how you satisfied yourself of it. Where the Property lies in the State of Punjab and has no revenue record at all — a site in the abadi deh or within the lal lakir, or a property inside municipal limits — say so in terms and run item A.6 of Schedule A instead of leaving this clause unanswered.

4. Estate particulars, where the Property lies in the Union Territory of Chandigarh. The Property is House, Site or Booth No. House No. 1234, Sector 21-B. It is held on a leasehold tenure. It is carried on the Estate Office record under Property ID CHD/EO/21B/1234. The allotment is evidenced by Allotment Letter No. EO/AL/21B/1234/1996 dated 12 August 1996. The Property was allotted by Greater Mohali Area Development Authority (GMADA), and that allotment file is part of the title. Where the Property lies in the Union Territory of Chandigarh and the tenure stated above turns out to be wrong, that fact alone is to be reported to me at once and before the rest of the work is done, because almost everything else in Schedule B turns on it.
