When you need it

You're checking if pending litigation concerns rights to the property — the lis pendens rule, s.52, Transfer of Property Act, 1882. Give owner/claimant names and case references; confirm each case concerns this property, since a name match alone isn't enough and no online hit isn't proof no suit exists.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty: not an instrument under s.2(14), Stamp Act, 1899; plain paper. A ₹1 revenue stamp applies only on a receipt over ₹5,000 (s.30, Art.53, Sch.I).

Registration

Not registrable under section 17, Registration Act, 1908.

Notarisation

Not required unless an affidavit is needed.

Witnesses

Not required; identity matters more.

LIS PENDENS SEARCH REQUEST

Request date: 1 April 2026

Applicant: Aarav Sharma, Sector 21, Panchkula. Property: Plot 118, Sector 35-A, Chandigarh (Plot/land), Plot 118, Sector 35-A; prior deed no. 2345..

Names to search: Harpreet Singh; R.K. Mehta..

Litigation scope: Civil suits concerning title or possession. Known case/notice: Civil Suit 118/2024, District Court Chandigarh.

Search source: Relevant court case indexes and e-court records. Additional strategy: Search District Court and Punjab & Haryana High Court party-name records.

Required output: Case list with current status and property relevance.

Please identify only cases materially connected to rights in the stated property and report current status, court, case number, parties and the source checked.

LEGAL BASIS

Under section 52 of the Transfer of Property Act, 1882, a transfer made while a suit is pending in which the right to the property is directly and specifically in question does not affect the rights of the parties under the decree, which is why a buyer searches for such suits. In Punjab a registered lis pendens is the only litigation a Non-Encumbrance Certificate will show, so use the property-under-litigation search on rcms.punjab.gov.in as well; neither is a search of the courts' own records. Chandigarh has no notified Non-Encumbrance Certificate service.
