When you need it

Each person intending a civil ("court") marriage under the Special Marriage Act, 1954 gives this affidavit — one per party, not one for the couple — alongside the notice of intended marriage under section 5 of that Act, to the Marriage Officer of the district where at least one of them has resided for the thirty days immediately before the notice. It declares age, present marital status, mental capacity to consent, and that the two are not within a degree of relationship the Act prohibits unless a custom governing them permits it.

Not the notice of intended marriage itself, which the Act prescribes its own form for, and not the declaration the parties and three witnesses sign at the marriage under section 11 of that Act — this affidavit supports the notice stage only. Different Marriage Officers ask for it in slightly different forms in practice, so check the specific office's own requirement before the appointment. Not for registering a marriage that has already been solemnised — use a marriage registration application for that instead.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A general affidavit, chargeable under Article 4 (Affidavit) of Schedule 1-A of the Indian Stamp Act, 1899 as applicable to Punjab, and under the corresponding entry of that Schedule as applicable to the Union Territory of Chandigarh — commonly a small fixed value, typically Rs 10, on non-judicial stamp paper or an e-stamp certificate. Confirm the current value with the stamp vendor before buying it, and separately ask the specific Marriage Officer's office whether it expects any particular stamp value or format for this supporting affidavit, since practice varies office to office.

Registration

Not compulsorily registrable — this affidavit only supports the section 5 notice and is kept on the Marriage Officer's own file, not lodged with the Sub-Registrar. The marriage itself, once solemnised under the Special Marriage Act, 1954, is registered by the Marriage Officer as part of that Act's own procedure, which is a separate step from this affidavit.

Notarisation

Sworn or affirmed before a Notary Public appointed under the Notaries Act, 1952, or an Oath Commissioner appointed by the Punjab and Haryana High Court for the courts at the place of execution. Some Marriage Officers accept attestation by an Executive Magistrate instead; confirm the specific office's own practice before the appointment, since an affidavit attested the wrong way can mean the notice is not accepted on the day.

Witnesses

Not compulsory for this affidavit itself. Do not confuse it with the three witnesses required at the marriage itself under section 11 of the Special Marriage Act, 1954, or with any objection that may be raised against the notice under section 7 of that Act during the thirty-day waiting period — both are later, separate stages.
