When you need it

The sworn affidavit that the marriage took place — on stamp paper and notarised, one of the two a Marriage Registration Application may ask for, and equally the paper a bank, employer or insurer wants on its own. A married person who needs a general sworn statement confirming their marriage — its date, place and the fact that it took place — for a bank or joint account KYC update, an employer's personnel records, adding a spouse as an insurance nominee or dependant, a child's school or college admission, a housing society or utility record, or any other counter that asks for proof of marriage and will accept a notarised affidavit rather than, or in addition to, a marriage certificate.

Also useful where the marriage was solemnised long ago by custom or religious rite and was never formally registered, or where registration is still pending and something is needed in the meantime. Not for: the age-and-marital-status affidavit filed before a Marriage Officer to arrange a court marriage under the Special Marriage Act, 1954 (use the Court Marriage Affidavit in this library instead); a passport application specifically (use the Passport Annexure Affidavit or the Passport Spouse Name Addition Affidavit); registering the marriage itself with the Registrar (use the Marriage Registration Application); or changing your own name after marriage (use the Name Change after Marriage Affidavit). Punjab and Chandigarh: sworn before a Notary Public or an Oath Commissioner, then produced directly at the counter that needs it.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4 (Affidavit), Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab — non-judicial stamp paper, commonly a small fixed denomination, bought from a licensed stamp vendor or e-stamped through the Stock Holding Corporation of India Limited (SHCIL, shcilestamp.com), the sole e-stamping agency for Punjab. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal head, e-stamped via SHCIL or bought at the Treasury, Sector 17. Both articles have been revised by amendment in recent years and neither department publishes a single dated rate card for a simple affidavit; confirm the current denomination with the stamp vendor or SHCIL before the notary appointment — a notary will not swear an affidavit onto paper bought afterwards.

Registration

Not a registrable instrument. Section 17 of the Registration Act, 1908 reaches instruments affecting immovable property and a handful of other named categories; a general affidavit of marriage is neither, so there is no Sub-Registrar step. It is complete on notarisation and is then produced directly before whichever bank, employer, insurer, school or society needs it.

Notarisation

Sworn before a Notary Public appointed under the Notaries Act, 1952 and the Notaries Rules, 1956, or affirmed before an Oath Commissioner appointed by the District & Sessions Judge of the district. Both are equally acceptable to the authorities this affidavit is typically produced before. The deponent signs in the notary's or Oath Commissioner's presence, not before.

Witnesses

None required by law. A notarised or sworn affidavit is authenticated by the notary's or Oath Commissioner's own seal and register entry, not by attesting witnesses. Some notaries nonetheless ask for an identifying witness where the deponent is not personally known to them — carry a second photo ID in case one is asked for.
