कब ज़रूरत पड़ती है

विशेष विवाह अधिनियम, 1954 के तहत सिविल («कोर्ट») विवाह करने वाला हर व्यक्ति यह शपथ-पत्र देता है — हर पक्ष का अलग, जोड़े का एक नहीं — उस अधिनियम की धारा 5 के तहत विवाह की सूचना के साथ, उस ज़िले के विवाह अधिकारी को जहाँ उनमें से कम-से-कम एक सूचना से ठीक पहले तीस दिन रहा हो। इसमें आयु, मौजूदा वैवाहिक स्थिति, सहमति देने की मानसिक क्षमता, और यह घोषणा होती है कि दोनों अधिनियम द्वारा वर्जित रिश्ते में नहीं हैं, जब तक उन पर लागू कोई रिवाज़ इसकी इजाज़त न दे।

Some Marriage Officers accept attestation by an Executive Magistrate instead; confirm the specific office's own practice before the appointment, since an affidavit attested the wrong way can mean the notice is not accepted on the day.

Not compulsory for this affidavit itself. Do not confuse it with the three witnesses required at the marriage itself under section 11 of the Special Marriage Act, 1954, or with any objection that may be raised against the notice under section 7 of that Act during the thirty-day waiting period — both are later, separate stages.

AFFIDAVIT

(In support of the notice of intended marriage under section 5 of the Special Marriage Act, 1954)

I, Karanvir Singh, son/daughter of Balwinder Singh, born on 1 April 2026, Marketing Executive, resident of House No. 3110, Sector 71, S.A.S. Nagar (Mohali) 160071, do hereby solemnly affirm and declare as under:

1. That I am the male party (bridegroom) in the marriage intended to be solemnised with Manpreet Kaur under the Special Marriage Act, 1954, and am competent to swear this affidavit.

2. That I have completed the age required of me by section 4(c) of the Special Marriage Act, 1954 as on the date of this affidavit, my date of birth being as stated above.

3. That I am unmarried and have never been married to any person.

4. That I am not incapable of giving a valid consent to this marriage in consequence of unsoundness of mind; that though capable of giving valid consent, I am not suffering from a mental disorder of a kind or to an extent unfit for marriage and the procreation of children; and that I am not subject to recurrent attacks of insanity, within the meaning of section 4(b) of the Special Marriage Act, 1954.

5. That I am not related to the other party to this intended marriage within the degrees of prohibited relationship specified in the Special Marriage Act, 1954.

6. That I have resided within the district of S.A.S. Nagar (Mohali) since 2 April 2026, immediately preceding the notice of intended marriage to be given under section 5 of the Special Marriage Act, 1954.

7. That this affidavit is sworn in support of the notice of intended marriage between myself and Manpreet Kaur, to be given to the Marriage Officer-cum-Sub-Divisional Magistrate, S.A.S. Nagar (Mohali), the State of Punjab.

8. That the contents of this affidavit are true and correct to my knowledge, no part of it is false, and nothing material has been concealed therefrom.
