When you need it

Subletting needs landlord consent — unlike a guest, it's a secondary occupation. Name the sub-tenant, portion, dates, sub-rent and the tenant's liability; no direct landlord-subtenant relationship arises from consent alone.

Unauthorised subletting risks serious rent-law consequences.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Depends on effect — mere consent isn't the sublease; a separate sublease is stamped on its own term and consideration.

Registration

Not registrable as consent. A s.17(1)(d) sublease needs registering within 4 months (s.23), subject to s.25.

Notarisation

No substitute for registration; consent needs none.

Witnesses

Both sign; witnesses help, though irrelevant to registration.

LANDLORD CONSENT FOR SUBLETTING

Date: 3 April 2026

Harpreet Singh, landlord of House 118, Sector 35-A, Chandigarh, consents to Aarav Sharma, tenant since 1 April 2026, granting the limited subletting described below to Rohan Verma, currently of House 211, Sector 21, Panchkula.

Approved term: 2 April 2026 to 3 April 2026. Scope: Entire residential premises.

Monthly sub-rent: ₹18,000 (Rupees Eighteen Thousand only). Utilities: Sub-tenant reimburses the tenant as separately agreed. Use: Residential use only in accordance with the head tenancy.

Original tenant liability: Original tenant remains fully liable to the landlord under the head tenancy.

Direct landlord relationship: No direct tenancy or privity with the landlord is created by this consent. Further occupation: No further subletting, licensing or paying-guest arrangement is permitted without fresh written consent. Special conditions: Sub-tenant to complete society occupation form before move-in.

This consent ends no later than the head tenancy and does not survive its lawful termination. Nothing here authorises forcible eviction of the sub-tenant; possession disputes must be handled through lawful process.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023. Personal data in this document is collected only to record and administer the landlord's specific consent to the stated residential subletting, communicate about that purpose, verify the information expressly supplied, and retain an evidentiary record.

The record will be held by Green Residency Owners Association and may be shown only to the landlord, tenant, authorised property manager or property consultant involved in this tenancy, the utility/service provider, society or building manager directly involved in the stated purpose, and a statutory authority where disclosure is required for the transaction recorded here.

If the requested connection, consent or transaction does not proceed, or this document is withdrawn before it takes effect, the personal data will be retained for 90 days from that decision and then erased. If it proceeds, the record will be retained for the term of the tenancy or transaction plus 12 months and then erased, except for a record that a statute requires to be kept for a longer named period.

A person named in this document may withdraw consent for future consent-based processing, request correction or erasure when the stated purpose has ended, or raise a grievance by writing to support@kagaznama.com. The record-holder should acknowledge and respond within 30 days.

Data minimisation: this document deliberately does not require a full Aadhaar number, Aadhaar-card copy, PAN, bank-account credentials, passwords or unrelated identity material. Detailed identity verification should remain in the separate KYC process unless the stated service independently requires a lawful KYC step.
