When you need it

A deceased person still appears in a record despite completed succession. Distinguish a stale clerical entry from an UNDECIDED inheritance — don't delete the name without entering lawful successors; Punjab's separate inheritance-mutation route means this isn't a shortcut around it.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty — not a transfer instrument, so outside the Stamp Act, 1899. An affidavit filed is separately chargeable under Article 4, Schedule I-A (Punjab); a Chandigarh Estate Office correction likewise bears none.

Registration

Not registrable — outside s.17, Registration Act, 1908. A mistake inside a REGISTERED deed is different — fixed by its own rectification deed.

Notarisation

Not required, unless the authority asks for an affidavit.

Witnesses

Not required; documentary comparison and verification matter more.

REMOVAL OF A DEAD PERSON'S ENTRY

Application date: 2 April 2026

Applicant: Aarav Sharma, Sector 21, Panchkula, capacity Recorded owner/right-holder. Phone: 98765 43210; email: aarav@example.com.

Record: Punjab, SAS Nagar, Kharar, Village Kharar; Khewat 114, Khatauni 226, Khasra 18//12.; 4 kanal land, full ownership share.; Jamabandi 2022-23.

DECEASED ENTRY

Deceased: Harpreet Singh, date of death 1 April 2026, certificate DTH/2025/118.

BASIS

Removal basis: Inheritance mutation already sanctioned. Source: Inheritance Mutation 221/2025. Resulting holder/share: Aarav Sharma and Naina Sharma, half share each..

REQUEST

Please remove the stale deceased-person entry only together with the lawful resulting record, or direct completion of the necessary succession proceeding first.

LEGAL BASIS

In Punjab a death changes the rights in the record rather than correcting it: the heirs' names are entered by a mutation of inheritance (virasat, commonly called the fauti intkal) reported under section 34 of the Punjab Land Revenue Act, 1887 and attested by the Circle Revenue Officer, and a fard badar cannot carry that change. Paragraph 7.30 of the Punjab Land Records Manual bars using a mutation to correct an entry already incorporated in a jamabandi, so a stale entry left behind after a sanctioned mutation is corrected by a fard badar under paragraph 7.29. In Chandigarh a sector property has no jamabandi; a transfer on an intestate death goes through the Estate Office and needs a public notice.
